1. Buffalo / Birmingham Investors, LLC, a Delaware limited partnership, as DEVELOPER,
was required to construct and install public water mains and appurtenances per City of Encinitas
Tract 18-074 at a property located at 1231 Birmingham Drive and 1832 Westview Drive in
Encinitas, CA.
2. Buffalo / Birmingham Investors, LLC, a Delaware limited partnership is located at 700
Second Street, Encinitas, CA 92024.
3. Buffalo / Birmingham Investors, LLC, a Delaware limited partnership contracted with LB3
Enterprises, Inc. located at 12485 Highway 67 N, Lakeside, CA 92040, as CONTRACTOR, to
construct and install the required public water mains and appurtenances.
4. Buffalo / Birmingham Investors, LLC, a Delaware limited partnership contracted with the
San Dieguito Water District to operate and maintain the required public water mains and
appurtenances, as OWNER in fee of the facilities, upon satisfactory completion and pursuant to an
easement granted by Buffalo / Birmingham Investors, LLC, a Delaware limited partnership.
San Dieguito Water District is headquartered at 160 Calle Magdalena, Encinitas, CA 92024.
6. Said improvements were completed by the DEVELOPER and CONTRACTOR and were
accepted by the San Dieguito Water District Board of Directors on the 15th day of December 2021.
7. The San Dieguito Water District Board of Directors, on the 15th day of December 2021,
authorized the General Manager to record the "Notice of Completion."
8. Buffalo / Birmingham Investors, LLC, a Delaware limited partnership posted security in the
amount of $90,000. The security, in the amount of $70,000, has been released. The District will
retain security in the amount of $20,000. This security will remain in full force at this time and shall
be released at the end of the one-year warranty period.
9. All requirements of said improvements have hereby been satisfied except for warranty.
10. Neither acceptance of said improvements by the Board of Directors nor this Notice
constitute a waiver of any defects in the work of the construction or installation of said
improvements.
