FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, SAN
DIEGUITO WATER DISTRICT, an Irrigation District of the State of California, hereby
release(s) and forever quitclaims to:
OWNER OF RECORD: The Corradini-Atchley Living Trust
An easement for water pipe lines and incidental purposes as granted to the San Dieguito
Irrigation District on May 15, 1956 in Book 6100, Page 246 to 250 of Deeds for a permanent
easement of right-of-way in and over that strip of land described as follows:
E1/2 of the NWIA of the SWIA and the W1/2 of the NE1/4 of the SW1/4; all being in
Section 23, Township 13 South, Range 4 West, SBB&M.
The route of said easement of right of way across the aforesaid lands shall be as follows:
Beginning at a point on the Southerly line of the said E1/2 which is S 89144135" W 12 feet
from the SE corner thereof; thence N 0°39108" E along a line parallel with the Easterly line
of the said E1/2 and 12 feet Westerly therefrom 325 feet to point "A"; thence continuing N
0139'08" E along the last described line 826 feet to a point; thence N 34*42' W 37.70 feet to
a point; thence N 37001'10" W 114.75 feet to a point; thence N 53148'25" W 58.70 feet,
more or less to a point in the Northerly line of the said E1/2, said point being N 8915548"
W 157.75 feet from the NE corner of said E1/2 of the NW1/4 of the SW1/4.
Beginning at a point "A" in the above description thence in a direct line 674.74 feet, more
or less, to a point in the Easterly line of the said W1/2 of the NE1/4 of the SW1/4, said point
being N 0130'15" E 325 feet, measured along the said Easterly line of the W1/2, from the SE
corner of the said W1/2 of the NE1/4 if the SW1/4
Located on the property described as:
THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE CITY OF
ENCINITAS, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA AND IS DESCRIBED
AS FOLLOWS:
LOT 56 OF POINSETTIA HEIGHTS UNIT NO. 2, IN THE CITY OF ENCINITAS, COUNTY
OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREON NO. 4483,
FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY,
MARCH 16, 1960.

By signing this form, the Owner of Record acknowledges that all easements being quitclaimed
are being left in place in an "as -is" condition. Owner of Record acknowledges that the San
Dieguito Water District is conveying all rights, title, and interest to the easement, right-of-way,
and abandoned pipeline to the Owner of Record in an "as -is" condition. Owner of Record further
acknowledges that the San Dieguito Water District does not warranty the condition of any
abandoned pipe nor guarantee its fitness for any purpose. Owner of Record agrees to defend,
indemnify, protect, and hold harmless the San Dieguito Water District, each member of its Board
of Directors, agents, officers, and employees from and against any and all claims asserted or
liability established for damages or injuries to any person or property, including bodily injury to
the Owner of Record's employees arising out of or in any manner directly or indirectly
connected with the Owner of Record's use of the quitclaimed easement, right-of-way, and
abandoned pipe, however caused, except for sole negligence, willful misconduct, or active
negligence of the San Dieguito Water District.
