A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS, CALIFORNIA
ESTABLISHING A REVISED PERMIT PARKING ZONE ON VIA MOLENA (FROM 200’ EAST OF
VIA TAVIRA TO VIA CANTEBRIA), VIA TAVIRA, VIA SARASAN, VIA PALACIO
AND VIA VILLENA
WHEREAS, the City of Encinitas Municipal Code Chapter 14.41 sets forth procedures and regulations
for establishing permit parking zones to protect residential areas of the City; and
WHEREAS, at the February 22, 2023 City Council meeting, the City Council determined that the
subject permit parking zone met the requirements stipulated in the Municipal Code; and
WHEREAS, on April 12, 2023 the City Council established a Permit Parking Zone on these same
streets through Resolution No. 2023-22; and
WHEREAS, staff have determined that certain residents who typically park on the subject streets were
inadvertently left out of the permit parking zone when it was established; and
WHEREAS, a revised permit parking boundary would enhance or protect the quality of life in the area
threatened by noise, traffic hazards, environmental pollution, or devaluation of real property resulting from
long-term, non-residents’ parking; and
WHEREAS, the City Council accordingly desires to rescinded Resolution No. 2023-22 that established
the original Permit Parking Zone and boundary and adopt this Resolution No. 2023-105 to set forth the revised
permit parking boundary as set forth herein below.
NOW, THEREFORE, BE IT RESOLVED that a permit parking program is established in the
geographical area defined below such that vehicles properly displaying a valid permit shall be rendered exempt
from the specified parking limitations.
The following locations are hereby declared to be a permit parking zone subject to the provisions of
Chapter 14.41 of City of Encinitas Municipal Code and the times and manner of parking restriction or
prohibition shown below:
(a) Residential Permit Parking Zone on Via Molena (from 200’ east of Via Tavira to Via Cantebria), Via
Tavira, Via Sarasan, Via Palacio and Via Villena.
(b) No stopping, standing, or parking shall be permitted between the hours of 10:00 p.m. to 8:00 a.m.
every day on the above-mentioned streets, except with a permit or as otherwise exempt under the
Vehicle Code.
(c) The geographic boundary of the zone is depicted in Exhibit A.
(d) Each resident of a dwelling unit within the Permit Parking Zone on Via Tavira, Via Sarasan, Via
Palacio and Via Villena, each resident of a dwelling unit on Via Terrassa, Via Solaro and Via
Morella, each resident of the Ritz Colony (located at 1190 Encinitas Blvd, Encinitas CA 92024) and
each resident of the Cape Apartments (located at 120 Via Cantebria, Encinitas, CA 92024) can
receive one “Resident” permit for each vehicle owned or leased by the resident, as shown on the
vehicle’s registration or insurance documentation. Each dwelling unit on the foregoing streets may
receive a maximum of three “Visitor” permits at any one time.

(e) The fee for each Resident permit or Visitor permit is $5.00. “Resident” permits do not expire. “Visitor”
permits are valid for a maximum of 30 days from their commencement date.
NOW, THEREFORE, BE IT FURTHER RESOLVED that Resolution No. 2023-22 is hereby
rescinded.

residents on Via Tavira, Via Saransan, Via Palacia, Via Villena, Via Terrassa, Via Solaro and Via Morella.
Residents of Ritz Colony apartments (located at 1190 Encinitas Blvd, Encinitas CA 92024) and residents of the
Cape Apartments (located at 120 Via Cantebria, Encinitas, CA 92024) are also eligible for parking permits.
Parking will be by permit only between the hours of 10:00 p.m. to 8:00 a.m. on the shaded streets below: Via
Molena (from 200’ east of Via Tavira to Via Cantebria), Via Tavira, Via Sarasan, Via Palacio and Via Villena.
