This Certificate of Compliance merges the two underlying lots (14 and 15 in Block 36 of Map No. 1334 recorded on May 13, 1911), located at 2052 Montgomery Avenue, (as described herein as Exhibit "A") into one lot. All underlying lots are located within the Residential 15 (R-15) Zone and may be merged in accordance with Encinitas Municipal Code (EMC) Chapter 24.76 (Lot Mergers: Provisions and Procedures). City Council authorized staff to initiate lot mergers within the R-15 zone on April 13, 2011. Government Code Section 66451.11 and EMC Section 24.76.020 list the requirements for a lot merger. The two lots are eligible for a merger in accordance with EMC Sections 24.76.020A, B1, and C as summarized below: Municipal Code Section 24.76.020 (Requirements) A. At least one of the affected parcels is undeveloped by any structure for which a building permit was issued or for which a building permit was not required at the time of construction, or is developed only with an accessory structure, or accessory structures, or is developed with a single structure, other than an accessory structure, that is also partially sited on a contiguous parcel or unit. Lot Merger Conformance Prior to city incorporation in 1986, an existing one- story, single-family residence was built on the common lot line between the contiguous Lots 14 and 15. B. Both Lots 14 and 15 are owned by the same property owner, LRT Ventures, LLC, a California Limited Liability Company, therefore, this code requirement is satisfied. This Certificate of Compliance (COC) deems the lot legal and available for development.
