The Development Services Department of the City of Encinitas has determined that the parcel of real
properties described below have been divided or have resulted from a division in compliance with the
Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The parcels described
herein may be sold, leased, or financed without further compliance with the Subdivision Map Act or any
local ordinance enacted pursuant to the Act. Development of the parcels may require issuance of a permit
or permits, or other grant or grants of approval.
The subject property is located at 824 Hermes Avenue (APN: 256-040-07-00). This Certificate of
Compliance is for the merger of two existing, underlying legal lots of record, as described herein as Exhibit
"A." The existing lots comply the overall R-8 zoning designation development standards except for one
interior side yard and the minimum lot width. Furthermore, the lots comply with the goals and policies of
the General Plan, as well as the City's adopted Local Coastal Program.
The following findings are necessary to approve such a merger, pursuant to Municipal Code Chapter
24.76 (Lot Merger):

(Requirements)
A. At least one of the affected parcels is
undeveloped by any structure for
which a building permit was issued or
for which a building permit was not
required at the time of construction, or
is developed only with an accessory
structure, or accessory structures, or
is developed with a single structure,
other than an accessory structure,
that is also partially sited on a
contiguous parcel or unit.
Lot Merger Conformance
Lots 13 and 14 are developed with a one-story single-
family residence straddling the common lot line
between the two lots. According to the Residential
Building Record, the existing structure was built on
Lots 13 and 14 as a one-story single-family home in
1959 prior to the city's incorporation in 1986.
B. With respect to any affected parcel, The merger meets condition B.1 as each existing lot
one or more of the following conditions (Lot 13 — 3,750 square feet; Lot 14 - 3,750 square
exists: feet) are a part of Map 570 recorded on October 23,
1888, and comprise less than 5,000 square feet in
area at the time of the determination of merger.

(Requirements)
1. Comprises less than 5,000 square
feet in area at the time of the
determination of merger.
2. Does not meet current standards
for sewage disposal and domestic
water supply.
3. Does not meet slope stability
standards, so that no buildable
site is possible.
4. Has no legal access which is
adequate for vehicular and safety
equipment access and
maneuverability.
5. Its development would create
health or safety hazards.
6. Is inconsistent with the City of
Encinitas General Plan, and any
applicable specific plan, other
than minimum lot size or density
standards.
C. For purposes of determining whether
contiguous parcels are held by the
same owner, ownership shall be
determined as of the date that notice
of intention to determine status is
recorded.
Lots 13 and 14 are owned by the same property
owner (Monica Cristina Marquez); therefore, this
code requirement is satisfied.
