DIEGUITO WATER DISTRICT, an Irrigation District of the State of California, hereby
release(s) and forever quitclaims to:

the following described real property in the City of Encinitas, County of San Diego, State of
California:
An easement for water pipe lines and incidental purposes as granted to the San Dieguito
Irrigation District on March 17, 1950 as Instrument No. 30873 in Book 353, Page 373 of
Official Records for a permanent easement of right-of-way in and over that strip of land
described as follows:
The lands in which such easement of right-of-way is hereby granted are situated in the
County of San Diego, State of California, and particularly described as follows, to wit:

Southwest Quarter of the Northwest Quarter of Section 26 and the Northeast Quarter of
Section 27, all being in Township 13 South, Range 4 West, San Bernardino Meridian, in the
County of San Diego, State of California, according to United States Government Survey
approved April 1.9, 181.

The route of said casement of right-of-way across the aforesaid lands shall be as follows:
Beginning at a point on the South line of said Northwest Quarter distant thereon South 891
28' East 503.60 feet from the Southwest corner thereof-, said point being on a 262.02 foot
radius curve concave Northeasterly a radial line to said curve at said point bearing South
46' 15' 20" West; thence Northwesterly along said curve through a central angle of 111 201
40" a distance of 51.88 feet; thence tangent to said curve North 321 24' West 892.92 feet to
a point on the West line of said Northwest Quarter distant thereon North 0' 30' West
790.05 feet from the Southwest corner thereof.
Thence North 321 24' West 664.67 feet to the beginning of a tangent 1000 foot radius curve
concave Southwesterly; thence Northwesterly along said curve through a central angle of
151 251 30" a distance of 269.22 feet; thence tangent to said curve North 47' 49' 30" West
218.91 feet to a point on the Easterly line of Cardiff, according to Map thereof No. 1298,
filed in the Office of the County Recorder of San Diego County November 14, 1910 said
point being distant along said Easterly line South 90 38' East 150.32 feet from the
Southwesterly line of Edinburg Avenue as shown on said Map of Cardiff.

San Bernardino Meridian, in the County of San Diego, State of California, according to
United States Government Survey approved April 19, 1881.
Beginning at the East Quarter corner of said Section 26; thence Westerly along the East
and West center line of said Section 26, a distance of 4631.55 feet to the Northwesterly
corner of that parcel of land described in deed to Monte Griffiths et ux, recorded January
11, 1936 as Document No. 1966 in Book 469, page 64 of official Records, said North-
westerly corner being the true point of beginning of the line herein described; thence from
said true point of beginning, South 20' 39' East along the Southwesterly line of said
Griffiths' Land.

Water District on December 13, 1991 as Instrument No. 1991-0647526 of Official Records
for an exclusive and permanent easement of right-of-way in, upon, over and across the
lands hereinafter described, for the purpose of locating, relocating, constructing,
reconstructing, maintaining, operating, inspecting and repairing a pipe line or pipes lines,
and all fixtures and appurtenances incidental thereto for use in connection therewith, for
the transmission and distribution of water and all uses and purposes incidental thereto.

The land referred to herein is situated in the State of California, County of San Diego, City
of Encinitas and described as follows:
Those portion of the East half of Section 27 and the Northwest Quarter of Section 26 in
Township 13 South, Range 4 West, San Bernardino Meridian, in the City of Encinitas,
County of San Diego, State of California, according to the Official Plat thereof, described
as follows:
Beginning at a found concrete monument accepted as the West Quarter corner of said
Section 26; thence North 0' 06' 01" West, along the West line of said Section 26, 100.01 feet
to the North line of the South 100 feet of said Northwest Quarter; thence 791 521 06" East
639.26 feet to a point in the Southwesterly line of that Parcel of land described in Parcel 5
of that certain Final Order of Condemnation, filed for record on September 14, 1962 as
Instrument No. 159336, of Official Records of said County; thence along said
Southwesterly line as follows:
North 331 10' 44" West, 626.28 feet; North 32* 21' 0211 West,475.72 feet; and North 161 10'

By signing this form, the Owner of Record acknowledges that all easements being quitclaimed
are being left in place in an "as-is" condition. Owner of Record acknowledges that the San
Dieguito Water District is conveying all rights, title, and interest to the easement, right-of-way,
and abandoned pipeline to the Owner of Record in an "as-is" condition. Owner of Record further
acknowledges that the San Dieguito Water District does not warranty the condition of any
abandoned pipe nor guarantee its fitness for any purpose. Owner of Record agrees to defend,
indemnify, protect, and hold harmless the San Dieguito Water District, each member of its Board
of Directors, agents, officers, and employees from and against any and all claims asserted or
liability established for damages or injuries to any person or property, including bodily injury to
the Owner of Record's employees arising out of or in any manner directly or indirectly
connected with the Owner of Record's use of the quitclaimed easement, right-of-way, and
abandoned pipe, however caused, except for sole negligence, willful misconduct, or active
negligence of the San Dieguito Water District.
