This Notice of Lot Merger merges the two underlying Lots 45 and 46 in Block 22 of Map No. 1298 recorded on November 14, 1910 located at 2211 Manchester Avenue as described herein as Exhibit "A" and Exhibit "B" into one lot. The two underlying lots are located within the Residential 15 (R15) Zone and may be merged in accordance with Encinitas Municipal Code Chapter 24.76 (Lot Merger). The City Council authorized staff to initiate lot mergers within the R15 zone on April 13, 2011. Government Code Section 66451.11 and EMC Section 24.76.02 list the requirements for a lot merger. The two lots are eligible for a merger in accordance with EMC Sections 24.76.020A, B1, and C as summarized below: • Prior to city incorporation in 1986, the existing one-story, single-family residence was built on the common lot line between the contiguous Lots 45 and 46. • The R15 zone requires a minimum net lot area of 20,000 square feet, a minimum 40 feet in width, and 90 feet in depth. Lots 45 and 46 are 2,500 square feet each. The merged lot would be approximately 5,002 square feet in area and would be approximately 50 feet in width and 100 feet in depth, thereby complying with the required lot depth of 90 feet and width of 40 feet, but substandard in area. • Both lots 39 and 40 are owned by the same property owner, Paul S. Switgall, Trustee of the Paul S. Switgall Family Trust, dated July 30, 2014. This Certificate of Compliance (COC) deems the lot legal and available for development. The parcels described herein may be sold, leased, or financed without further compliance with the Subdivision Map Act or any local ordinance enacted pursuant to the Act.
