In accordance with your request, we have provided observation and compaction testing services
during remedial grading performed at Site I and Site 2 (see Location Map, Figure 1) at the subject
project. The project plans prepared by Dudek & Associates, Inc., are titled Grading Plans for: La
Costa Growers, 556 Union Street, Drawing No. 10516 -G, city signature dated October 26, 2010. The
project geotechnical report is titled Limned Geotechnical Investigation, 556 Union .Street Property,
Encinitas, California, prepared by Geocon Incorporated, dated December 5, 2008 (Project
No. 61021- 32 -01). The scope of our services consisted of performing in -place density tests and
observation services on a "part time" basis between August I 1 and 24, 2011.
The base map used to present the as- graded geology and the approximate locations of in -place
density tests performed during grading (Figure 2) was produced from an AutoCAD file of the
grading plans provided by Dudek & Associates, Inc. The map also depicts existing improvements
and, current and previous ground topography at the sites. For ease of mapping at Site 1, we did not
delineate the horizontal limits of compacted fill, undocumented fill, and Terrace deposits.
References to elevations, locations, and geologic contacts herein are based on surveyors' or grade
checkers' stakes in the field and /or interpolation from the referenced grading plans. Geocon
Incorporated does not provide surveying services and has no opinion regarding the accuracy of
as- graded elevations or surface geometry with respect to the approved grading plans or proper surface
drainage.

Grading consisted of removing debris laden fill from Site I and Site 2 located along the southwest
and northeast portions of the subject property, respectively. The fill was exported from the property.
Excavations up to six feet below the existing ground surface were performed to achieve finish grades.
The resulting ground surface was moisture conditioned as necessary and compacted. In some
instances, removals extended deeper than the design grades resulting in a depression on the ground
surface. Where this occurred, the bottom of the excavation was scarified, moisture conditioned as
necessary, and compacted prior to placing fill to re- establish design grades.
For the following references, we utilized the applicable ASTM version at time of testing. We
performed in -place density tests using a nuclear gauge in conformance with ASTM D 6938. Results
of the field tests are summarized in Table 1. In general, the in -place density test results indicate the
soils placed during remedial earthwork possess a dry density of at least 90 percent of the laboratory
maximum dry density near to slightly above optimum moisture content at the locations tested.
We performed laboratory compaction tests on representative soil samples in accordance with ASTM
D 1557 (maximum dry density and optimum moisture content). The results of laboratory tests are
summarized in Table II.
The grading performed at Site 1 and Site 2 resulted in less than approximately 18 inches of
compacted fill and dense Terrace Deposits at ground surface. The compacted fill at the sites is
underlain by undocumented fill. In this regard, settlement- sensitive improvements should not be
constructed at Site I and Site 2 without a comprehensive geotechnical investigation to evaluate the
site soil conditions.

LIMITED GEOTECHNICAL INVESTIGATION

In accordance with your request, we have performed a limited geotechnical investigation on the subject
property. The scope of our services consisted of a field investigation to evaluate the existing soil
conditions along two embankment zones located in the southwest and northeast portions of the site.
The intent of the study was to identify the extent of fill in these areas since the soils have apparently
been placed without a grading permit.
Figure 1 shows the approximate location of the two study areas. The base map used to depict the site
conditions (Figures 2 and 3) is an AutoCAD copy of topographic information provided by Dudek &
Associates Incorporated. The map depicts recently acquired surface topography in the study areas and
the approximate locations of the exploratory trenches. Figure 4 presents a cross section interpretation
of the subsurface conditions along Area No. 1.
Area No. I is located along the western property margin adjacent to an easement for Interstate 5 and
west of existing greenhouse structures (see Figure 2). It appears that an embankment was constructed
in this area with a west facing slope ranging in inclination from approximately 2:1 (horizontal:vertical)
to 0.5:1. The toe of the embankment appears to originate at the fence line marking the Caltrans Right -
of -Way and extends eastward to the level pad that supports greenhouses. An active municipal sewer
line underlies this area. A sewer manhole is also present in Area No. 1. We understand that the sewer is
relatively old.
Area No. 2 is located in the northeast comer of the property (see Figure 3). This area is at the top of a
slope that descends southward and westward from a level pad used for storage, to a relatively level site
that supports green house structures. The slope is approximately 12 -feet high and varies in inclination.

Observations of the ground surface indicate that the slope is generally comprised of dense natural
terrace deposits.
We performed the field investigation on October 16, 2008. Nine exploratory backhoe trenches were
advanced to a maximum depth of 11 feet below the ground surface using a John Deere rubber -tire
backhoe equipped with a 24- inch -wide bucket. The depth of excavation in Area No. 1 was limited due
to the existing sewer line. We visually examined, classified, and logged the soils encountered in
general accordance with ASTM D 2488, Standard Practice for Description and Identification of Soils
(Visual- Manual Procedure). It should be noted that an abandoned 10 -inch transite concrete pipe was
encountered along the southwest property margin (Area No. 1). Where observed, the pipe is located
approximately 5 to 6 feet below ground surface and is approximately 6 to 9 feet away from the existing
chain -link fence (see T6 and T8). Logs of the nine trenches are presented in Appendix A.
The field investigation revealed that the soils in the two study areas consist of undocumented debris fill
overlying Terrace Deposits (Trench T5, T7 in Area No. 1, Trench T9 in Area No. 2), or older trench
backfill presumed to be associated with construction of the original sewer and water line (TI through
T4, T6, T8, Area No. 1). The undocumented debris fill consists of a mixture of loose to medium dense
sandy soil, organic debris and trash including plastic, concrete, wood, brick, and other deleterious
materials. The thickness of this deposit ranged from one foot (Trench T5 and T7) to seven feet
(Trench T4).
The embankment beneath the debris fill in Area No. 1 appears to have been placed during the
construction of the original sewer /water improvements within the easement. Although we do not have
direct evidence, we believe this to be a likely explanation because of the existence of this material
directly above the sewer line and the unlikelihood that trench spoils would have been removed from the
site subsequent to the initial construction. The fill consists of medium dense, brown, silty sand with a
marked difference in moisture and density from the overlying debris laden materials. In both areas, the
undocumented fills are underlain by Terrace Deposits consisting of medium dense to dense brown silty
sand (T3, T5, T7, and T9).
In summary, it appears that an undocumented debris fill was placed over a pre-existing embankment in
Area No. 1, and minor debris fill is present in Area No. 2. We recommend that remedial grading
measures be performed in these two areas to remove the debris laden fill and improve the ground
surface geometry with respect to drainage and stability. It is understood that Dudek & Associates will
be preparing a grading plan for submittal to the City of Encinitas implementing our geotechnical
recommendations for these areas.

REMEDIAL RECOMMENDATIONS
Based on the discussion above, the following remedial measures are recommended to remove the
unsuitable soils (undocumented debris fills) and improve the drainage and stability of the two study
areas.
1. Prior to commencing site work, a preconstruction conference should be held with the owner,
grading contractor, civil engineer, and geotechnical engineer in attendance. Special soil
handling can be discussed at that time. The work area should be evaluated by the contractor to
check that there are no existing underground improvements that may be damaged during the
remedial grading (e.g. irrigation lines, sewer).
2. It is imperative that the contractor /owner obtain permission to grade within the sewer easement
in Area No. I by the appropriate governing agency prior to commencing any work.
Coordination with the agency to accurately identify the line and grade of the existing pipe(s)
shall be performed. Thorough markout and pot- holing, if necessary, shall be performed by the
contractor to assure that the existing sewer line or any other improvements are not damaged in
any way during the grading.
3. The debris laden fills (Undocumented Debris Fill) located in Area Nos. I and 2 are unsuitable
and should be removed and exported from the site. The estimated limits of these areas are
shown on Figures 2 and 3. The depth of removal should be such that fill left in -place is
relatively free of debris and in a relatively dense condition. Based on our field observations,
the depth of remedial grading will vary between 2 feet and 7 feet below the existing ground
surface. The actual extent of remedial grading should be evaluated in the field by the
geotechnical engineer or engineering geologist. Some compaction effort along the resulting
slope face in Area No. I may be necessary upon completion of the excavation.
4. It is anticipated that an excavation initiating at the chain -link fence along the property
boundary of Area No. 1, and extending eastward at a ratio of 4:1 will remove the majority of
the Undocumented Debris Fill within the main body of the embankment (see Figure 4). Some
areas may require a flatter excavation to remove the debris fill, particularly on the north and
south sides of Area No. 1. Other areas may encounter Terrace Deposits at a shallower depth
that would enable a steeper slope ratio. Subsequent to the grading, the resulting slope should be
contoured to provide proper uniform surface drainage. Civil improvements such as a brow
ditch, and/or other drainage devices should be considered for this area by the project civil
engineer.
5. Remedial grading in Area No. 2 should consist of removing and exporting the Undocumented
Debris Fill debris along the top of the slope. The estimated area of removal is shown on

Figure 3. The resulting surface should be contoured to provide proper uniform surface drainage
in a similar manner as Area No. 1.
6. In the event that minor amounts of fill are needed to establish surface grades, the base of
excavations should contain a keyway, be scarified to a depth of 12 inches, moisture
conditioned as necessary and compacted to at least 90 percent of the maximum dry density as
determined by ASTM D 1557 prior to placing fill. In addition, the slope along the southwest
property margin (Area No. 1) should be compacted such that the surficial soils are uniformly
compacted to at least 90 percent relative compaction along the face of the finished slope. This
may require track walking with a bull dozer upon completion.
7. Where applicable, graded slopes should be landscaped with drought- tolerant vegetation having
variable root depths and requiring minimal landscape irrigation. In addition, all slopes should
be drained and properly maintained to reduce erosion.
8. Adequate drainage provisions are imperative. Under no circumstances should water be allowed
to pond near top of slopes or existing surface improvements. The graded areas should be
sloped such that drainage water is directed away from slope tops to controlled drainage devices
9. We recommend that all excavations be observed during grading by a representative of Geocon
Incorporated to check that soil and geologic conditions do not differ significantly from those
expected.

project geotechnical report is titled Limited Geotechnical Investigation, 556 Union .Street Property,
Encinitas, California, prepared by Geocon Incorporated, dated December 5, 2008 (Project
No. G 1021-32-01 ). The scope of our services consisted of performing in -place density tests and
observation services on a "part time" basis between August I I and 24, 2011.
The base map used to present the as- graded geology and the approximate locations of in -place
density tests performed during grading (Figure 2) was produced from an AutoCAD file of the
grading plans provided by Dudek & Associates, Inc. The map also depicts existing improvements
and, current and previous ground topography at the sites. For ease of mapping at Site 1, we did not
delineate the horizontal limits of compacted fill, undocumented fill, and Terrace deposits.
References to elevations, locations, and geologic contacts herein are based on surveyors' or grade
checkers' stakes in the field and/or interpolation from the referenced grading plans. Geocon
Incorporated does not provide surveying services and has no opinion regarding the accuracy of
as- graded elevations or surface geometry with respect to the approved grading plans or proper surface
drainage.

Grading consisted of removing debris laden fill from Site I and Site 2 located along the southwest
and northeast portions of the subject property, respectively. The fill was exported from the property.
Excavations up to six feet below the existing ground surface were performed to achieve finish grades.
The resulting ground surface was moisture conditioned as necessary and compacted. In some
instances, removals extended deeper than the design grades resulting in a depression on the ground
surface. Where this occurred, the bottom of the excavation was scarified, moisture conditioned as
necessary, and compacted prior to placing fill to re- establish design grades.
For the following references, we utilized the applicable ASTM version at time of testing. We
performed in -place density tests using a nuclear gauge in conformance with ASTM D 6938. Results
of the field tests are summarized in Table 1. In general, the in -place density test results indicate the
soils placed during remedial earthwork possess a dry density of at least 90 percent of the laboratory
maximum dry density near to slightly above optimum moisture content at the locations tested.
We performed laboratory compaction tests on representative soil samples in accordance with ASTM
D 1557 (maximum dry density and optimum moisture content). The results of laboratory tests are
summarized in Table 11.
The grading performed at Site I and Site 2 resulted in less than approximately 18 inches of
compacted fill and dense Terrace Deposits at ground surface. The compacted fill at the sites is
underlain by undocumented fill. In this regard, settlement- sensitive improvements should not be
constructed at Site I and Site 2 without a comprehensive geotechnical investigation to evaluate the
site soil conditions.

Dear Mr. Maldonado:
As part of the site assessment and submittal package, the City of Encinitas (City) referenced
conducting a formal hydrologic study of the 0.2 acre site, in addition to standard site assessment
and plan designs. This letter details the findings of Dudek's site assessment for suitability of a
formal hydrologic study.
The site is located approximately 0.5 mile south of Leucadia Boulevard, and directly east and
adjacent to the 1 -5 right -of -way. The site is gently undulating, with no slopes steeper than a 2:1
gradient, and is surrounded on all sides by residential development and roadways. The site is not
located in, contain, or have adjacency to natural waterways or drainages, U.S. Army Corps of
Engineers (ACOE) jurisdictional Traditionally Navigable Waters of the U.S. (WOUS) or ACOE
jurisdictional wetlands. No California Department of Fish and Game (CDFG) jurisdictional
wetlands or wetland vegetation communities are present on or adjacent to the site.
Given the project site's 0.2 acre footprint, lack of significant slope gradients, and lack of
adjacency to waterways or aquatic resources, it is determined that a formal hydrologic modeling
study would not be suitable for this site. No project aspects would significantly alter the existing
site topography and hydrology in a way that would adversely impact current run -off and drainage
patterns.

This letter summarizes the requirements for pulling your Engineering Permit for drawing 10516 -G. Your
approved plan will remain valid for one year. If the permit is not issued within six months from the dale of
approval of the drawings, the plans will be subject to review by City staff for compliance with current codes
and regulations before a permit can be issued, and changes to the approved plans as well as additional
roes may be required.
Please read through this letter carefully and contact the City with any questions you may have. It
contains information about many requirements that may apply to your project and can make the
process clearer and easier for you.
In order to obtain the permits to construct the work shown on your approved plans, you will need to satisfy
the requirements below. All of the items listed below must be submitted to the Engineering front counter
in one complete package at the time the applicant comes in to pull the permit Partial submittals of any
kind will not be accepted. Your project planchecker will not accept any of the documents listed on behalf
of the Engineering front counter staff, all items must be submitted to the front counter directly together and
at one time. The correct number of each of the requested documents must be provided: copies of
documents submitted to the City during plancheck do not reduce the necessary quantities listed below.
(1) Provide 4 prints sets of the approved drawing 10516 -G
Provide 2 copies of soils report "Limited Geotechnical Investigation, 556 Union Street Property,
Encinitas, California," prepared by Geocon, Inc. and dated December 5, 2010.
(2) Post Security Deposits to guarantee all of the work shown on your approved drawings. The
amounts of security deposits are determined directly from the Approved Engineer's Cost Estimate
for bonding purposes by your engineer dated September 22, 2010 according to a set of
predetermined unit prices for each kind of work shown on your plans. You will be required to post
security deposit(s) as follows:
(a) Security Deposit for Grading Permit 10516 -G: in the amount $26.254.80 to guarantee both
performance and labor/ materials for earthwork, drainage, private improvements, and erosion
control.
(b) Security Deposit for Improvement Permit: N/A
(c) Security Deposit for Undergrounding of Overhead Utilities: N /A.
(d) Security Deposit for Deferred Monumentation: N /A.
A minimum of 20% and up to 100% of the amount listed in item(s) 2(a) must be in the form of
cash, certificate of deposit, letter of credit, or an assignment of account. Up to 80% of the amount
listed in item 2(a) may be in the form of auto - renewing Performance and Labor and Materials
Bonds issued by a State of California licensed surety company.
Up to 100% of the amount(s) listed in item(s) 2(b), 2(c), and /or 2(d) may be in the form of auto -
renewing Labor and Materials bonds issued by a State of California licensed surety company.
Cash, certificates of deposit, letters of credit, and assignments of account are also acceptable
financial instruments.
If a certificate of deposit (CD) will be obtained to secure the entire amount(s) listed in item(s) 2(a)
and/or 2(b), two separate CD's for 25% and 75% of the amount(s) listed in item(s) 2(a) and /or
2(b) should be obtained in order to facilitate any future partial release of those securities. CD's
posted may be of any term but must be auto - renewing and must specify the City of Encinitas as a
certificate holder and include a clause that until the City of Encinitas provides a written request for
release of the CD, the balance shall be available to the City upon its sole request.
The format of any financial instrument is subject to City approval, may be in the owner's name
only, and must list the City of Encinitas as a Certificate Holder.

The grading and improvement inspection fees are calculated based on 5% of first $100,000.00 of
the approved Engineer's cost estimate for Fees dated September 22, 2010 (modified per M.
Maher on April 22, 2011) and 3% of the cost estimate over 5100,000.00. The NPDES inspection
fee is assessed as 1 % of the first $100,000.00 of the approved Engineer's cost estimate and 0.6%
of the cost estimate over $100,000.00. The flood control fee is assessed at a rate of $0.21 per
square foot of net new impervious surface area for driveway and parking areas as created per the
approved plan.
141 Provide the name, address, telephone number, state license number, and license type of the
construction contractor. The construction of any improvements within the public
right -of -way or public easements is restricted to qualified contractors possessing the
required state license as listed in the table below. The contractor must also have on file with
the City current evidence of one million dollar liability insurance listing the City of Encinitas as co-
insured. Additional requirements are described in the handout "Requirements for Proof of
Insurance" available at the Engineering front counter.

5i Permits are valid for no more than one year from the date of issuance and may expire earlier due
to expirations of letter of credit and /or insurance policies.
t6 i This project does not propose land disturbance in excess of one acre and does not require from
the State, a Storm Water Pollution Prevention Plan (SWPPP). An erosion control plan shall be
implemented per the approved grading plan.
Preconstruction Meeting: A preconstruction meeting at the project site is mandatory for all projects.
The preconstruction meeting may not be scheduled until the Engineering pennit(s) have been issued, and
the applicant /contractor must give the assigned Engineering inspector a minimum of 48 hours advance
notice prior to the scheduled meeting time.
Right -of -Way Construction Permit: A separate rail; w way construction permit will be required for any
work in the public right -of -way or public easements Typically, this work may include construction or
reconstruction of a portion of the driveway within the public right -of -way, excavation, backfill, and
resurfacing to install electric. gas, telephone, and cable television lines, or water and sewer connections.
A permit fee of $300.00 per application and a site plan preferably the work order issued by the public
utility, will be required. Contractor license and insurance requirements apply. Permits must be issued at
least 48 hours in advance of the start of work
Haul Routes, Traffic Control Plans, and Transportation Permits: These separate permits may be
required for your project and are handled by the Traffic Engineering Division. A fee of $250.00 is required
for traffic control plans. For more details, contact Raymond Guarnes, Engineering Technician, at (760)

Release of Project Securities The partial or complete release of project securities is initiated
dutainatically by the City after submission of satisfactory as-buih drawin s to the Ci y an_d,approval_bv the
prolert ELigneerinq_Dn ipgclor. Applicant requests cannot . be addressed_ without release approval from the
proiect inspector. The processing and release of securities may take up to 4 weeks after the release
process is initiated by the project Engineering inspector. Any cash releases will be mailed to the address
on this letter unless the City is otherwise notified, and all letters mailed to a financial institution will be
copied to the owner listed hereon. Satisfactory completion of Final Inspection certified by the project
Engineering inspector is a prerequisite to full release of the Security Deposit assigned to any Grading
Permit. A sum in the amount of 250X of the securities posted for improvement permits will be held for a
one -year warranty period, and a release is automatically initiated at the end of that warranty period.
Construction Changes: Construction changes prepared by the Engineer of Work will be required for all
changes to the approved plans. Requests for construction change approval should be submitted to the
Engineering Services Department front counter as redlined mark -ups on 2 blueline prints of the approved
Drawing. Changes are subject to approval prior to field implementation. Substantial increases in valuation
due to the proposed changes may be cause for assessment and collection of additional inspection fees
and security deposits. Construction change fees of $200 00 and $350.00 will be assessed for minor and
major construction changes, respectively. Construction changes necessitating a new plan sheet will be
assessed the per -sheet plancheck and NPDES plancheck fees in lieu of the construction change fee.
Construction changes not previously approved and submitted as as -built drawings at the end of the
construction process will be rejected and the securities release will be delayed.
Change of Ownership: If a change of ownership occurs following approval of the drawing(s), the new
owner will be required to submit to the City a construction change revising the title sheet of the plan to
reflect the new ownership. The construction change shall be submitted to the Engineering front counter
as redline mark -ups on two blueline prints of the approved drawing together with two copies of the grant
deed or title report reflecting the new ownership. Construction change fees apply The current owner will
he required to post new securities to replace those held by the City under the name of the former owner,
:md the securities posted by the former owner will be released when the replacement securities have been
eceived and approved by the City.
Change of Engineer of Work: If a change in engineer of work occurs following the approval of the
drawing(s), a construction change shall be submitted for review and approval by the Engineering
Department_ Two copies of the forms for the assumption of responsibility by the new engineer and the
release of responsibility by the former engineer shall be completed and submitted to the City.
Construction change fees apply.
As- builts: Project as -built drawings prepared by the Engineer of Work will be required prior to Final
Grading acceptance by Engineering Services. Changes to the approved plans require a construction
change to be submitted to the City prior to field implementation. Construction changes may not be
s.ibmitted as as- builts at the end of the construction process.
