The Clean Water Program (CWP) has received numerous complaints regarding
sediment and water discharging from the project during the storm event beginning the
week of December 27, 2004, continuing until January 4, 2005. The Fire Department
responded initially on Friday, December 31 and contacted Greg Shields and Jim
Knowlton for assistance. The site was inspected and found to have no drainage system
in place to allow rain water to leave the site. Engineering staff worked with the
superintendent, Reza Cheraghali, to construct a desilting basin at the base of the
southernmost building pad. The basin was constructed with overflow pipes to allow the
water to discharge onto Burgundy in the event that the basin was filled.
CWP staff inspected the site on Monday, January 3, during rain and found silty
discharge to the street on Burgundy. The superintendent was contacted and a full
inspection was performed. A STOP WORK was issued as a result of the inspection.
The STOP WORK required:
1. All slopes within the sites be covered and stabilized.
2 Perimeter controls shall be installed around all pads so as to contain water on the
pads.
3 All water be contained on -site.
On January 4, 2005, the site was re- inspected by CWP staff and Regional Water
Quality Control Board Staff, Chris Means. RWQCB inspection was prompted by a
complaint from a resident on Burgundy. The inspections resulted in the issuance of a
Notice of Violation for the discharge by the RWQCB. Those present (Greg Shields, Jim
Knowlton, Ron Quigg, Paul Hartman, Chris Means, and Reza Cheraghali) agreed on
several Best Management Practices (BMPs) to be implemented onsite to control the
amount of discharge necessary and the amount of sediment in the discharge. Required
BMPs are:
1. Implement BMPs required on City inspection /Stop Work from January 3.
z Construct a second desilting basin at the western edge of the site to provide
more capacity to retain water (when weather permits). The basins should be
designed by the developer's engineers.
3 Install the pump as an emergency measure to pump water from the surface of
the second basin up to Gascony. The pump may be used only in the event that
the water will breach the second basin and flow into the residences below.
4. Install a filter bag on the end of the pipe to filter sediment from the water prior to
discharge onto Gascony.
The RWQCB asked that the superintendent fill out necessary and regular inspection
forms as provided in the SWPPP for the project.
RWQCB also requested that the City inspection forms be forwarded to allow the
RWQCB to monitor progress on the site. The site priority will now be changed to high
within our program. This will require weekly inspections which I will co- ordinate with
Ron Quigg.

Dear Mr. Rasbidi:
I have been retained by Ken Scott, who resides 1685 Burgundy Road, in Encinitas,
California. On January 11, 2005, Mr. Scott received a letter regarding an attempt by La
Costa Estates, LLC, to gain an easement to construct a private storm drain system to
direct the flow of natural occurring run off water which has been unnaturally altered due
to the development of the four single - family homes by your company on the property
located above his residence.
My client wants to go on record that he does not agree to the alternative action that has
been proposed, i.e., that of pumping the water onto Gascony Road, because of the
expense involved and because that solution is the least efficient means of correcting the
problem.
My client understands that an easement was, in fact, offered, but that La Costa Estates,
LLC would be required to pay for the easement; a fact that is not addressed as one of the
reasons you claim the "easement has not been obtained."
My client also concurs with the position of Richard Southard, President of the Skyloft
Homeowner's Protective Corporation who in a letter dated February 17, 2005, objected
to access to the drainage ditch flowing down Burgundy and high risk of water crossing
the crown in the road and the attendant negative impact on the homes.
This letter is being sent to the Encinitas Planning Commission, to the attention of Mr.
Shields, as well as to the Encinitas City Attorney to register Mr. Scott's concerns and to
reserve for Mr. Scott all legal avenues of redress he may be forced to employ to protect
his property interests should the matter not be expeditiously resolved by the responsible
entities employing a common sense approach. Needless to say, Mr. Scott and the other
voters affected by the ultimate decision will be monitoring the progress of this important
issue.

The State Construction permit does allow the water to be filtered and discharged off -site. It was my
understanding the developer would be using a silt sack to filter any impounded water on site, thus allowing
it to be discharged onto Gascony.
If the residents are concerned with vector issues, perhaps it would be best to get the water out of there.
The BMP I described above is inexpensive, and, while not appropriate for larger construction sites would
most likely be suitable for a small site like the one in question. If you are unfamiliar with this form of
filtration, talk to Paul Hartman in your stormwater unit, he knows what I am talking about.

Greg Shields was also copied on my response. He heads the construction
division and I am sure that he will direct the developer to get rid of
the standing water to the extent practicable. State Water Quality does
not allow pumping of muddy water into the storm drain. We have to let
the water either percolate into the ground or use it for watering the
on -site soils. Unfortunately with either approach we cannot get rid of
the water immediately.

Re: Meeting Encinitas City Hall, Jan. 18, 2005 and resulting property
damage.
Dear Mr. Rashidi
This letter is to reaffirm conversations I have had with Reza and to try to
get the damage fixed.
As yc,ii know on Oct. 19 through Oct. 21, 2004 we received heavy rainfall that
was exacerbated by your grading that changed the topography of the slope.
This caused the drainage ditch along the south side of my property to be
completely wiped out. I talked to Re a on Oct. 21, 2004 about this and he
agreed to fix the problem, in the mear� time some plastic was placed over some
of the ditch. That is all that has been done.
On Jan. 3, 2005 during another heavy rain your water was being pumped to
drain down the south side of my property which further increased the damage
to this ditch.. This was done without my permission and cannot be construed
as natural runoff. Each additional rain further increases the damage. This
is a hrief history. My concerns are as follows.
This flitch runs alongside a tall block retaining wall. This wall was en-
gineered, permitted and inspected by the County of San Diego. This retain-
ing wall is supporting my house. All of your unauthorized drainage has
eroded the lateral support along the footings of this wall. The eroded
areas are now allowing the water to pond which percolates down next to the
footings further jeopardizing the integrity of this wall.
This was a very expensive wall to build and cannot be easily repaired, if
at all. That cost could easily run into the hundreds of thousands of dol-
lars. I am very concerned over the viability of this wall now, and also
realize structural problems may not show up until months later. This prob-
lem cannot be solved by throwing some flower seeds on your slope nor will
it be acceptable to send a mexican with a shovel to try to fix the problem.
There is also a secondary problem with your drainage collecting in a ditch
along my block wall fence on my easterly property line. This water is per-
colating down along the footings of this wall also.

As was pointed out at the meeting on Jan. 18, 2005 there were serious er-
rors made by the City and Developer that resulted in putting my property
at extreme risk. The homeowners most affected were never notified that
certain codes were not going to be enforced and said homeowners were not
given a chance to secure their property against damage.
We need to get this problem fixed now. What I would find acceptable is a
person with engineering and /or construction background to foreman this work.
He should understand how to fix it and why it needs to be fixed and without
causing further damage to my property. I have attached the "Job Specs" to
fix this problem. Because of all of the extra time I have had to spend oft
this, I have included an 'extra work' item to compensate a little for all
of the inconvenience I have had to incur. This item is a wood border run -
ninq from the top of the slope to Burgundy. It should be done before the
dirt is brought in.
I would like to point out that out of all of the homeowners involved I have
suffered the greatest damage and potential damage to my property. I am
furious over this whole situation and especially over the cavalier attitude
of the City and to a lesser extent of the developer in putting my residence
in such grave danger.
