Corrections or comments here do not relieve the contractor from compliance with the requirements of the drawings and
specifications. The contractor is responsible for confirming and correlating all quantities and dimensions, processes and
techniques of construction, and of performing his work in a safe manner in compliance with the requirements of the plans
and specifications.
Items included in this submittal are listed noting the action taken and recommendations given and are reviewed for general
conformance to the project design and in general compliance with the specifications.
1. Bolts and Nuts — Grade B bolts and nuts by Tripac are acceptable.
2. Gaskets — Gaskets by Tripac are acceptable.
3. 4" —8" PVC Pipe — Class 150 PVC pipe by J -M Pipe is acceptable.
4. Ductile Iron Fittings — Flanged and Union -Tite fittings manufactured by Tyler/Union are acceptable
provided they are cement lined and seal coated in accordance with AWWA C104, with a bituminous
coating. Mechanical joint fittings do not meet District standards. Amend as noted.
5. PVC Deflection, Closure and ACxPVC Adapter Couplings— Couplings by CertainTeed are acceptable.
6. Restrainer — Uni -Flange Series 1300 is acceptable.
7. Detectable Tape — Tape is acceptable as submitted.
8. Locating Wire— Wire should be 10 awg solid copper instead of stranded wire. Amend as noted.
9. Copper Tubing — Type K "Soft" copper tubing by Cambridge -Lee is acceptable.
10. Service Saddle — Jones Saddle No. J996 is acceptable.
11. Meter Box — This project will use dual meters (P -3/4 ") which will require J &R Concrete No. Wl l -B or
equivalent. Also need meter box for 1 '/;' meter. Rejected — resubmit.
12. Gate Valve — Clow Gate Valve with flange ends is acceptable. Plans also call for flange by push -on gate
valve. Amend as noted.
13. 2" Curb Stop — Jones No. J -1974W is acceptable.
14. 1" Curb Stop — Jones No. J-4201 is acceptable.

We herein provide a brief summary of the status of the earthwork construction at the subject project.
The mass grading, including the building pads and roadways, is essentially complete. Lots 1, 2 and
14 require some additional minor or finish grading. The construction of the retaining walls for the
building lots and roadway have been completed. The slope subdrains for the lots 1, 2, and 3 have been
installed. Since the groundwater level below the lots north of Lot 3 are thought to be significantly
below the finished pad level, the toe of slope subdrains for these lots, as originally shown on the
plans, is not thought to be necessary. The construction of the bridge structures has not started. The
construction of the sewer has been completed.
Six settlement platforms have been monitored since Mayor June 2000. A tabulation of the settlement
platform reading is attached. The latest measurement interval, between August 7 to September 6,
2000, indicated nil, or slight downward movement. An exception was Platform 3 on Lot 14 that
showed a rise of 0.04 feet. We expect any future movement at these locations to be insignificant.

This letter presents recommendations for the asphaltic concrete pavement structural sections to
be constructed for the recently graded roadways within the subject project.
Representative samples of the subgrade materials were collected at two locations from the
roadways. The samples were delivered to Christian - Wheeler Engineering for R -value laboratory
testing. The results of the R -value tests are attached for your review. The traffic indices (TI) used
in the design were obtained from the City of Encinitas. The pavement structural sections were
determined in accordance with the procedures provided by California Test 301 ( CALTRANS -
Manual of Tests, Vol. 2) and the CALTRANS Highway Design Manual. The final recommended
pavement structural section presented herein is the minimum section as specified by the City of
Encinitas Public Road Standards. The recommended structural sections for all roadways in the
subdivision are as follows:
Asphaltic Concrete : 4 inches
Aggregate Base (Class 2): 6 inches
Compacted Native Subgrade: 6 inches at 95 percent compaction
The aggregate base and at upper 6" of the supporting subgrade soil should be compacted
to not less than 95% of maximum dry density, as determined by ASTM D1557. Further, all
pavement section materials and paving procedures should comply with the "Standard
Specifications for Public Works Construction ", latest edition, including the "Standard Special
Shcpardson Engineering Associates. Inc.

Provisions ", prepared by San Diego County Department of Public Works.
The City of Encinitas also requires the concrete curb and gutter to be underlain by a 6 -inch layer
of compacted aggregate base.

This letter presents recommendations for the asphaltic concrete pavement structural sections to
be constructed for the recently graded roadways within the subject project.
Representative samples of the subgrade materials were collected at two locations from the
roadways. The samples were delivered to Christian - Wheeler Engineering for R -value laboratory
testing. The results of the R -value tests are attached for your review. The traffic indices (TI) used
in the design were obtained from the City of Encinitas. The pavement structural sections were
determined in accordance with the procedures provided by California Test 301 ( CALTRANS -
Manual ofTests, Vol. 2) and the CALTRANS Highway Design Manual. The final recommended
pavement structural section presented herein is the minimum section as specified by the City of
Encinitas Public Road Standards. The recommended structural sections for all roadways in the
subdivision are as follows:
Asphaltic Concrete : 4 inches
Aggregate Base (Class 2): 6 inches
Compacted Native Subgrade: 6 inches at 95 percent compaction
The aggregate base and at upper 6" of the supporting subgrade soil should be compacted
to not less than 95% of maximum dry density, as determined by ASTM D1557. Further, all
pavement section materials and paving procedures should comply with the "Standard
Specifications for Public Works Construction ", latest edition, including the "Standard Special

This submittal provides recommendations for deepening and repositioning of the sub - drains planned
on the above three lots. These modifications are intended to account for encountered position of the
subsurface water on these lots.
The attached drawing shows the suggested new position of the subdrains along the rear and north
property lines. The subdrain should follow Alternative B details shown on Plate A5 of the
Supplemental Geotechnical Investigation and Update Report, dated November 9, 1999.
The minimum depth is to be increased to 5 feet and a minimum drainage gradient of 2 %. The
perforated pipe section for each lot should be connected to a 6" diameter, non - perforated collector
pipe positioned near the front of the lots The collector pipe should then discharge into the storm
drain inlet box near Station 2 +60+ of Vivaldi Drive

We herewith provide recommendations for installing a subdrain/stabilization zone below the invert of the sewer
to be constructed at the subject project. The relatively high groundwater encountered and the deep trench
planned prompts us to make this recommendation. The recommendation is intended to assist in the trench
dewatermg and to promote a more stable base for the sewer bedding.
We have attached excerpted copies of the grading plan (Plates AI and A2) that shows the groundwater levels
along the Vivaldi Drive sewer alignment, as encountered during the drilling of supplemental exploratory borings
on May 31, 2000 In some locations there may be up to 15 feet of water above the sewer invert level
The attached sewer trench sub -drain and stabilization detail (Plate A3) shows our tecormriendation for a two -
foot deep subdram below the originally planned sewer trench bottom Crushed rock back5ll of this subdrain
zone and the pipe zone to one -foot above the pipe is recommended The rock/pipe zone is lobe totally encased
with a gootextile filter wrap This detail would apply for that section of the Vivaldi Drive sewer from Station
2+00 to Station 8 +27, and along Sewer Line B to Bach Strut. A 10 -inch mmunum diameter, iron - perforated
pipe should be installed outride the sewer alignment, and south of the Sewer Station 2 +00 to carry collected
water for ultimate discharge into the natural drainage channel near the recently constructed headwall/rip rap
of the storm drain crossing at the Rossini sewer extension. A cast -in -place concrete cut -off wall should be
installed in the trench near Station 2100 at the juncture of the drain pipe and the subdrain coming off of the

sewer trench bottom, The wall should be at least 8- inches thick and extend at least 12 inches beYond the
perimeter of the rock -filled portion of the coiurcettng trench.
A temporary cut-off wall is recommended in the trench of Sewer Line A near Station 11 +75. This cutoff is
intended to reduce the flow of water tamed within the trench backfill envelope that would otherwise tend to
flow to the sewer trench along Vivaldi Drive. The cutoff may be similar to that shown as Type B - Drawing
S -10 of the San Diego Regional Standards .

We herein provide an alternative method for supporting the bridge foundations that are currently planned to
cross the natural drainage course at two locations. The widths of the proposed concrete bridges are
approximately 20 feet at the Lots 20/21 crossing, and approximately 76 feet for the bridge crossing of Street
A. Current bridge plans show a clear span of approximately 16 feet with a rise of approximately 7 feet.
Recommendations for the bridge ground preparation and foundations was provided in the "Supplemental
Geotechnical Investigation and Update Report", dated November 9, 1999. This report recommended that the
foundation/approach fills of the road bridges, to be removed down to the firm Baypoint Formation, and the
grade brought up to final grade with compacted fill. At both locations, the contact with the Baypoint Formation
is at depths on the order of 4 to 7 feet below the groundwater level encountered on the date of the investigation.
As noted in the report, dewatering and diversion of the surface water within the drainage would be required to
facilitate the loose soil removal and replacement with compacted fill. We herein provide an alternate method
for ground preparation under the foundations that reduceF the dewatering requirements and the possible
problems with compaction replacement fill. The base of the bridge foundations is presently shown on the plans
at a level on the order of approximately 3 feet below the groundwater level. Therefore, some dewatering would
be required with the alternate method in order to facilitate construction of the cast -in -place bridge foundations
on a dry platform.

The attached drawing illustrates a gravel support system below the foundations. Briefly stated, the excavation
would be carried underwater, down to the Baypoint Formation. The required limits beyond the outward faces
of the foundations, are shown on the attached drawing. Following removal of the loose materials, a strong
geotextile drainage fabric would be draped across the excavation bottom/sides. We recommend a geotextile
similar to TC Mirafy 1120N, or Contech C- 120NW. A 3/4 ", maximum size, crushed rock would then be
infilled. The crushed rock should be placed while subject to vibration by submerged vibrators to assist in the
consolidation of the rock under water. Crushed rock would be brought up to the level of the proposed base of
the foundation, and the geotextile lapped at least 4 feet. This foundation treatment should underlie all the
proposed bridge foundations, including those for the bridge wing walls.
To facilitate the lowering of the groundwater as needed for construction of the foundations, the contractor may
wish to incorporate drainage pipes or a sump well within the crushed rock to allow pumping and lowering of
the water table to a sufficient level to allow foundation form and concrete placement. The lowered groundwater
would have to be maintained until all the soil backfill atop the gravel support system has been backfilled to a
level above the static water level.
The foundation system supported by the above crushed rock support system should be designed for allowable
bearing pressures not exceeding 3,000 lbs. /sq. ft.

Brandywine Development this permit for the development described below,
subject to the attached Standard and Special Conditions.

residential lots, one open space lot and one remainder lot, to include demolition of
several existing structures, grading, drainage and street improvements resulting in

STANDARD CONDITIONS:
Notice of Receipt and Acknowledgment. The permit is not valid and development
shall not commence until a copy of the permit, signed by the permittee or authorized
agent, acknowledging receipt of the permit and acceptance of the terms and
conditions, is returned to the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years
from the date on which the Commission voted on the application. Development
shall be pursued in a diligent manner and completed in a reasonable period of time.
Application for extension of the permit must be made prior to the expiration date.
Compliance. All development must occur in strict compliance with the proposal as
set forth below. Any deviation from the approved plans must be reviewed and
approved by the staff and may require Commission approval.
4. Interpretation. Any questions of intent or interpretation of any condition will be
resolved by the Executive Director or the Commission.
5. Inspections. The Commission staff shall be allowed to inspect the site and the
development during construction, subject to 24 -hour advance notice.
6. Assignment. The permit may be assigned to any qualified person, provided assignee
files with the Commission an affidavit accepting all terms and conditions of the
permit.
7. Terms and Conditions Run with the Land. These terms and conditions shall be
perpetual, and it is the intention of the Commission and the permittee to bind all
future owners and possessors of the subject property to the terms and conditions.
SPECIAL CONDITIONS:
The permit is subject to the following conditions:
1. Final Wetlands/Riparian Mitigation Plans, PRIOR TO THE ISSUANCE OF
THE COASTAL DEVELOPMENT PERMIT, the applicant shall submit to the Executive
Director for review and written approval, a final wetland mitigation plan for all
freshwater marsh and riparian impacts associated with the proposed project. The final
mitigation plan shall be in substantial conformance with the mitigation plan submitted
with this application by Dudek and Associates, Inc. dated December 28, 1998.
The permittee shall undertake mitigation in accordance with the approved plans. Any
proposed changes to the approved plans shall be reported to the Executive Director. No
changes to the plans shall occur without a Coastal Commission approved amendment to
COASTAL DEVELOPMENT PERMIT NO. A- 6- ENC -98 -129

this coastal development permit unless the Executive Director determines that no
amendment is required.
2. Final Revised Monitoring Program. PRIOR TO THE ISSUANCE OF THE
COASTAL DEVELOPMENT PERMIT, the applicant shall submit for review and
written approval of the Executive Director a final revised monitoring program designed
by a qualified wetland biologist. Said monitoring program shall be in substantial
conformance with the monitoring plan submitted with this application by Dudek and
Associates, Inc. dated December 28, 1998, but shall be revised to include the following:
a. Submittal, within 30 days of completion of construction (i.e., grading, planting
and installation of irrigation devices) at the mitigation site, of an as -built assessment
of the mitigation project that includes as -built plans, to determine if the project has
been built as proposed.
b. Annual reports on the monitoring program shall be submitted to the Executive
Director for approval for a period of five years. Each report shall include copies of
all previous reports as appendices. Each annual report shall also include a
"Performance Evaluation" section where information and results from the
monitoring program are used to evaluate the status of the mitigation project in
relation to the performance standards detailed in the mitigation plan.
c. At the end of the five year period, a comprehensive monitoring report prepared in
conjunction with a qualified wetland biologist shall be submitted to the Executive
Director for review and approval. This comprehensive report shall consider all of
the monitoring data collected over the five -year period in evaluating the mitigation
project performance. If the report indicates that the mitigation has been, in part, or
in whole, unsuccessful, the applicant shall be required to submit a revised or
supplemental mitigation program to compensate for those portions of the original
program which were not successful. The revised mitigation program, if necessary,
shall be processed as an amendment to the subject coastal development permit.
The permittee shall undertake monitoring in accordance with the approved program. Any
proposed changes to the approved program shall be reported to the Executive Director.
No changes to the program shall occur without a Coastal Commission approved
amendment to this coastal development permit unless the Executive Director determines
that no amendment is required.
3. Grading and Erosion Control. PRIOR TO THE ISSUANCE OF THE
COASTAL DEVELOPMENT PERMIT, the applicant shall submit to the Executive
Director for review and written approval, final grading plans and erosion control plans
approved by the City of Encinitas. Said plans shall incorporate the following:
a. All permanent and temporary erosion control measures shall be developed and
installed prior to or concurrent with any on -site grading activities. Sediment
basins (debris basins, desilting basins, or silt traps) and other temporary erosion
control measures such as berms, interceptor ditches, sandbagging, hay bales,

filtered inlets, debris basins, silt traps, or other similar means shall be installed in
conjunction with the initial grading operation and maintained throughout the
development process as necessary to remove sediment from runoff waters
draining from the land undergoing development.
b. Demonstration that all on -site temporary and permanent runoff and erosion
control devices are installed and the City Engineer of Encinitas has determined
that all measures are in place and operating to minimize soil loss from the
construction site.
The permittee shall undertake development in accordance with the approved grading and
erosion control plans. Any proposed changes to the approved plans shall be reported to
the Executive Director. No changes to the plans shall occur without a Coastal
Commission approved amendment to this coastal development permit unless the
Executive Director determines that no amendment is required.
4. Drainage/Runoff Control. PRIOR TO THE ISSUANCE OF THE COASTAL
DEVELOPMENT PERMIT, the applicant shall submit final drainage and runoff control
plans approved by the City of Encinitas. Said plans shall be designed by a licensed
engineer qualified in hydrology and hydraulics, and assure no increase in peak runoff rate
from the developed site over runoff that would occur from the existing undeveloped site,
as a result of a ten -year frequency storm over a six -hour duration (10 year, 6 hour
rainstorm). Runoff control shall be accomplished by such means as on -site
detention/desilting basins. Energy dissipating measures at the terminus of outflow drains
shall be constructed. The runoff control plan, including supporting calculations, shall be
submitted to, reviewed and approved in writing by the Executive Director.
The permittee shall undertake the development in accordance with the approved plans.
Any proposed changes to the approved plans shall be reported to the Executive Director.
No changes to the plans shall occur without a Coastal Commission approved amendment
to this coastal development permit unless the Executive Director determines that no

5. Final Improvement Plans. PRIOR TO THE ISSUANCE OF THE COASTAL

approved by the City of Encinitas for proposed on- and off -site improvements associated
with the proposed development (private streets, two bridge crossings and storm drain
systems). Said plans shall be subject to the review and written approval of the Executive
Director.
The permittee shall undertake the development in accordance with the approved plans.
Any proposed changes to the approved plans shall be reported to the Executive Director.
No changes to the plans shall occur without a Coastal Commission approved amendment
to this coastal development permit unless the Executive Director determines that no

6. Street Sweeping. PRIOR TO THE ISSUANCE OF THE COASTAL
DEVELOPMENT PERMIT, the applicant shall submit to the Executive Director for
review and written approval, a final street sweeping program, which includes the
following elements:
a. Street sweeping shall occur at least monthly and shall begin immediately upon
completion of all on -site private street improvements and continue through the life of the
project.
b. Street sweeping shall be by means of a vacuumized sweeper and at least three
passes shall be made along each curb.
c. This program shall be incorporated into any Covenant, Code and Restrictions
(CCR's) for the development.
The permittee shall undertake street sweeping in accordance with the approved program.
Any proposed changes to the approved program shall be reported to the Executive
Director. No changes to the program shall occur without a Coastal Commission
approved amendment to this coastal development permit unless the Executive Director
determines that no amendment is required.
7. Other Permits. PRIOR TO THE ISSUANCE OF THE COASTAL
DEVELOPMENT PERMIT, the applicant shall submit to the Executive Director for
review and written approval, copies of all other required state or federal discretionary
permits for the development herein approved. Any mitigation measures or other changes
to the project required through said permits shall be reported to the Executive Director
and shall become part of the project. Such modifications, if any, may require an
amendment to this permit or a separate coastal development permit.
8. Future Development. This permit is for the subdivision of 16 acres, site
preparation, including rough grading, construction of roads and trails, utility and drainage
improvements,and mitigation for impacts to environmentally sensitive habitat areas. All
other development proposals for the site, including, but not limited to, construction of
residential structures or other structures, shall require review and approval under a
separate coastal development permit or an amendment to this permit.
9. Final Landscape Plans. PRIOR TO THE ISSUANCE OF THE COASTAL
DEVELOPMENT PERMIT, the applicant shall submit a detailed landscape plan for the
interim and any long -term plantings indicating the type, size, extent and location of all
plant materials, any proposed irrigation system and other landscape features. Drought
tolerant native and naturalizing plants shall be utilized to the maximum extent feasible.
Said plan shall be developed in consultation with the Department of Fish and Game to
assure species inherently noxious to environmentally sensitive species are avoided and
shall be submitted to, reviewed and approved in writing by the Executive Director and
include the following:

a. A planting schedule that indicates that the interim planting plan shall be
implemented within 60 days of completion of grading.
b. A written commitment by the applicant that all required plantings shall be
maintained in good growing conditions, and whenever necessary, shall be
replaced with new plant materials.
The permittee shall undertake the landscaping in accordance with the approved plans.
Any proposed changes to the approved plans shall be reported to the Executive Director.
No changes to the plans shall occur without a Coastal Commission approved amendment
to this coastal development permit unless the Executive Director determines that no
amendment is required.
10. Open Space Deed Restriction. No development, as defined in section 30106 of
the Coastal Act shall occur in the area generally described as wetland and buffer areas
surrounding Rossini Creek as shown on the attached Exhibit 'A" except for necessary
storm drain and desiltation/pollution basins, two bridge crossings across Rossini Creek
and grading and planting to accomplish proposed mitigation for impacts to sensitive
habitat areas and maintenance of the mitigation area.
PRIOR TO THE ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the
applicant shall execute and record a restriction in a form and content acceptable to the
Executive Director, reflecting the above restriction on development in the designated
open space area. The deed restriction shall include legal descriptions of both the
applicant's entire parcel and open space area. The deed restriction shall run with the land,
binding all successors and assigns, and shall be recorded free of prior liens that the
Executive Director determines may affect the enforceability of the restriction. This deed
restriction shall not be removed or changed without a Coastal Commission- approved
amendment to this coastal development permit unless the Executive Director determines
that no amendment is necessary.

potential of the soils within the channel at the subject project.
The subdivision project plans maintain the existing drainage channel with the addition of approach
embankments that will flank the channel at the sites of two roadway bridge crossings. The embankments will
be constructed with materials excavated from the site. We understand that there is a comprehensive plan to
promote the native vegetation in the channel, as well as replant similar vegetation in areas that are exposed or
newly created by the proposed grading.
The native soils, and the expected embankment soils, are silty sands to clayey sands. We estimate that the
permissible velocity of water flow within the channel where the soils are covered by native vegetation that is
well established is on the order of 5 feet per second.

Gentlemen:
This letter is intended to provide geotechnical recommendations supplemental to our referenced
report, that can assist your preparation of the project grading plans. We have reviewed the
preliminary topographic map and cross - sections for the westerly boundary area of the project as
submitted to our office on August 26, 1997. Our comments relative to this area of the project are
as follows.
1. If the retaining wall on the westerly property that adjoins Lot 26 should fall upon, or
near the plan slopes, we recommend a minimum setback of 8 feet horizontal between
the footing and the face of the slope. The footing of the wall would need to be exposed
to verify its position relative to property line and the proposed slope.
2. We understand you plan to provide fill slopes at a ratio of 2 horizontal to 1 vertical with
the top of the slope set back approximately 5 feet from the property line. This setback
is to allow for the construction of the fence and the browditch. This configuration will
generally result in composite slopes consisting of fill on the upper portion and cut into
the formational materials at the lower areas of the slope. With proper base key

benching of the fill slope portion this plan should be suitable for the construction of the
slopes. We also recommend a surface drain in the heel of the bottom key. We will be
submitting details for the above for your final plans.
3. There are existing deep, steep incuts into the native slopes near the common area of
Lots 29 and 30 which will require special design consideration. The adjoining properties
to the west have existing retaining walls, footings, and steep cuts that look marginally
stable, and which could adversely impact Lots 29 and 30. During our site visit in June,
seepage was noted to be outcropping some portions of some of the existing slope.
Buttress fills and /or engineered retaining structures appear to be warranted in order to
positively stabilize this area. We can work with your office on further details when you
are further along in your planning.
4. The proposed 2:1 slopes on the western side of Lot 31 will be partly in total cut and
partly in fill where a broad ravine /depression lies within the middle portion of the
natural slopes. A key, benching and subsurface drain similar to that discussed in No.
2 above will be required.
The proposed extension of Warwick Ave. into the southeast corner of the project will require a
retaining wall to support the higher ground and property along the south side of the right of way.
An existing house in this area is approximately 5 feet away from the property line. In June we
performed a shallow boring in this area to assess the soil conditions as they may affect the design
and constructibility of this retaining wall, as it is affected by the near proximity of the existing
structure. These soil conditions are generally favorable with a lightly cemented sandstone formation
present to a depth of 6 feet. Below this depth, the material looses cementation and is of low
cohesion. The upper 5 or 6 feet should provide generally stable excavations. However, any
excavation for the wall that extends below a plane inclined 45 degrees from the foundation of the
structure, or any improvements, will require special provisions during excavation in order to prevent
the undermining of the structural improvements. Again, we can work with your office regarding
further details regarding any special provisions when final grading plans become available.

This letter presents recommendations for stabilizing areas of unstable subgrade within the roadways at the
subject project. Very moist subgrade soils resulting in unstable conditions have been observed in scattered
locations along the alignments of Warwick Avenue and Vivaldi Drive.
In the unstable areas we recommend removal of a layer of the existing subgrade, the placement of a geotextile
fabric at the base of the excavation, and then the refilling to the planned level with compacted aggregate base.
The reconuriended removal depth is 6 inches mimmurn below the planned subgrade elevation, Thegeotextile
is intended to provide separation and reinforcement below the base, thereby enhancing the performance of
the structural section.

Dear Mr. Boeker
After inspecting the post rainfall conditions of your project, staff determined that direct runoff
from recently graded areas, improperly managed sediment -laden water, and temporary work
within the drainage is contributing sediment pollution to Rossini Canyon Creek and the San Elijo
Lagoon. Specifically, the following activities contributed sediment pollution to the creek:
• unprotected slopes and failing silt fences were inadequate to prevent erosion and contain silty
runoff (see photos);
• pumping of sediment -laden (chocolate milk) water indirectly to the creek via a storm drain
(see photo).
• unstabilized temporary work areas within the drainage contributed to scouring and
sedimentation (see photo).
It is the City's goal to obtain you voluntary compliance with the applicable rules and regulations.
Muncipal Code section 23.24 requires that adequate erosion and sedimentation control measures
be implemented as shown on the approved grading plan and section 64.08 prohibits the discharge
of pollutants to storm drains and surface waters. You can bring your project into compliance by:
• fully implementing and maintaining the approved erosion control plan for the project
(including protection of cut and fill slopes with erosion prevention measures
• educating all contractors and subcontractors about discharge prohibitions
stabilizing the streambed to eliminate scouring
A citation may be issued for any future unauthorized discharges of sediment. City stormwater

Pursuant to Section 23.24.310 of the Encinitas Municipal Code, this letter is hereby submitted as a Pad
Certification letter for lots 22 through 26. As the Engineer of Record for the subject project, I hereby
state all rough grading, for this unit has been completed in conformance with the approved plans and
requirements of the City of Encinitas Codes and Standards.
The following list provides the pad elevations as field verified and shown on the approved grading plan:
Construction of line grade for all engineered drainage devices have been field verified and are in
substantial conformance with the subject grading plan.
The location and inclination of all manufactured slopes have been filed verified and are in substantial
conformance with the subject grading plan. The construction of earthen berms and positive building
pad drainage have been field verified and are in substantial conformance with the subject.grading plan.

I have inspected the grading at the subject site and have verified certification of the pad by

concerned. However, this release is not intended to certify the project with respect to
other engineering concerns, including public road, drainage, water, sewer, park, and trail
improvements, and their availability, any other public Improvements, deferred

Prior to final inspection of the Building Permit(s) and legal occupancy, I need to be further
advised so that I can verify that final grading (i.e., finished precise grading, planting and
irrigation) has been completed in accordance with the approved plans and specifications.

Dear Mr. Barisic:
I received your letter dated July 18, 2001; you failed to address the issues that I
set forth in my letter dated July 17, 2001. Specifically, you made no mention of
Brandywine's obligations concerning the paving of the access road as well as the
reimbursement for the temporary fence that was necessitated by the dangerous condition
your firm created.
To address your letter, you stated that Brandywine is "desirous of utilizing access
ways other than our current easement through your property ... ". This issue has been
explained to you time and time again. You have no easement rights beyond Raspy
Growers. It is also arguable that you extinguished any easement rights to the road from
Santa Fe Drive by your actions of installing the fence, thus preventing its use. Therefore,
you are trespassing. You also state that your actions are necessitated by the actions of the
City of Encinitas. The City has no authority to unilaterally change the property rights of
an individual, nor has it ever given any notice of a desire to change such rights. I
strongly doubt the City would be willing to accept the consequences of such action,
namely damages incurred to our crops as well as our business activities.
This is not a game. I demand that you address the issue of the road as well as the
fence. Due to your present as well as past actions, it seems the only appropriate remedy
is to seek reimbursement now for the damages you have done. Please contact me at
760.753.2532, or fax a response to 760.632.1975. Until then, I reserve the right to protect
our property rights and block the gap in the fence from our road.

the document since Brandywine states that the city mandated it using the access through
the greenhouses which is trespassing. This is the case since they have no easement rights
to their opening in the fence. Please address this issue.
