PURSUANT TO CIVIL CODE SECTION 4285
The undersigned, RREG INVESTMENTS SERIES, LLC SERIES I018, a Delaware
limited liability company, being the record owner of the property hereinbelow described, does
hereby consent to the recordation of the hereinafter described Plan pursuant to California Civil
Code Section 4285.
Said property is situated in the City of Encinitas, County of San Diego, State of
California, and is described as:
Parcel 1 of Parcel Map 21412 in the City of Encinitas, County of San Diego, State
of California, filed in the Office of the County recorder of San Diego County on
December 1, 2016
Said property shall be a Condominium Project Common Interest Development described in
California Civil Code Section 4100.
Attached hereto, and by reference made a part hereof, is a composite diagrammatic
plan called Condominium Plan for 141 & 143 W Leucadia Boulevard (the "Plan") of the
Project ( "Project ") and the separate interests therein, consisting of (i) a description of the
Project that refers to or shows monumentation on the ground, and (ii) a three dimensional
description of the Project in sufficient detail to identify the common area and each separate
interest.
The Project and the Plan are subject to the definitions, terms and conditions stated in the
Declaration of Covenants, Conditions and Restrictions and Reservation of Easements for "141
& 143 W Leucadia Blvd" recorded concurrently herewith. Among others, the terms Unit, and
Common Area shall have those definitions contained in the Declaration as attached hereto as
Exhibit A.

COMMON AREA.
The "Common Area" depicted and more fully defined on this Condominium Plan, is a
three- dimensional portion of the Property consisting exclusively of a volume of air space located high
above Ground Elevation, beginning at a point that is ten feet below infinity and extending upwards to
infinity. It contains no earth or any natural or constructed physical objects or improvements. The
Common Area, exists in order to comply. with Civil Code §4500 for the establishment and existence of a
condominium project Common Interest Development, shall be owned by all Unit Owners in one -half
(1/2) undivided, equal "Fractional Interests" as tenants -in- common:
UNIT; UNIT SEPARATE INTEREST; CONDOMINIUM UNIT.
"Unit," "Unit Separate Interest," or "Condominium Unit" which terms are
synonymous in Project Declaration, shall mean and refer to an estate in the Property, or portions
thereof, as defined in Civil Code § §4125(b) and 4185(a) (2), or any similar statute hereinafter enacted,
each of which is not owned in common with the Owners of any other Unit in the Property. Units are
described and depicted in this Condominium Plan, where they are identified as Unit 1 and Unit 2. Each
Unit is a three dimensional division of land. (including airspace, earth, water and Improvements), the
lateral boundaries of which are vertical planes at the limits of the horizontal dimensions of each such
respective Unit as shown on the Plan, the upper limit extends to the lower limit of the Common Area 10
feet below infinity. The lover limit extends from the ground elevation down to the center of the earth.
Each Unit shall include the real estate interest, the Dwelling and all other Improvements located within
the Unit's boundaries. Each Unit shall be a separate freehold estate.
EASEMENTS; EASEMENT AREAS
"Easements ".shall mean and refer to those non - exclusive and exclusive easements and rights shown on
the Map, Condominium Plan, or otherwise of Record, and those specifically granted and reserved in the
Declaration and the other Governing Documents. Among others, "Easement Area(s)" shall mean and
refer to the "Access and Utility Easements" which include the following areas within the Property.
Burdening Unit 1: DRIVEWAY AND UTILITY EASEMENT AREA
On Unit 1, the "Driveway and Utility Easement Area" shall 'mean and refer to a) that portion of the
Property as shown on the Condominium Plan which is intended to provide a private easement of access
and for utility purposes for the benefit of Unit 2, on, over and across the driveway therein, to the degree
necessary for vehicular, pedestrian access, ingress and egress to and from Unit 2 from W. Leucadia
Drive, which easement shall also be granted to the Association upon activation if necessary for
Maintenance purposes; and b) that portion of the Property as shown on the Condominium Plan "which
is intended to provide an emergency access to the City of Encinitas as shown on the Final Map;
DRIVEWAY AND UTILITY EASEMENT AREA
On Unit 2, the "Driveway and Utility Easement Area" shall mean and refer to a) that portion of the
Property as shown on the Condominium Plan which. is intended to provide a private easement for
turnaround purposes for the benefit of Unit 1, on, over and across the area of the driveway depicted, to
the degree necessary, which easement shall be granted to the Association upon activation if necessary
for Maintenance purposes; and b) that portion of the Property as shown on the Condominium Plan
which is intended to provide an emergency access to the City of Encinitas as shown on the' Final Map.
CONSENT TO RECORDATION
Consent to recordation by Pacific Premier Bank, holder of the beneficial interest in that
certain Note secured by that Deed of Trust dated September 19, 2016 and recorded September
28, 2016 as Document No. 201670517538, affecting that certain property more particularly
described in said Deed of Trust.
