This agreement between McKellar Development Corporation (McKellar)
and Raymond V. and Norma J. Johnson, husband and wife, is for pur-
poses of paving an access road through a portion of Parcels 1 and
2 of Parcel Map 11245. McKellar hereby agrees to pave a sixteen
(16) foot wide roadway with two (2) inches of asphalt over four
(4) inches of acceptable base or equivalent.
The paved access road shall be within the twenty -five (25) foot
wide strip shown on Parcel Map 11245 and designated as 'Proposed
Private Road and Utility Easement." In consideration of McKellar
paving the access road, Johnson hereby agrees to grant a sewer
easement through said "Proposed Private Road and Utility Easement"
and a road easement and storm drain easement within Parcel 1 to
McKellar, has successors and assigns. In addition, Johnson agrees
to grant a ten(10) foot wide sewer easement to McKellar, his suc-
cessors and assigns, centered along the easterly property line of
Parcel 2 of Parcel Map 11245.
McKellar agrees to pay for two -- thirds of the cost of paving the
sixteen (16) foot access road and the full cost of installing the
sewer line. Johnson agrees to pay for one -third of the cost of
paving the access road. Payment is to be based on unit prices
established for construction of the McKellar project "Pacific
Ranch and Tennis Club, T.M, 4328." Construction of the access
road is to coincide with construction of the private streets
within the McKellar project.. Johnson is to provide finished grad-
ing for the construction of the access road.
