CERTIFICATE OF COMPLIANCE
(Section 66499.35 of the Government Code)
The Development Services Department of the City of Encinitas has determined that the parcels of real
property described below have been divided or have resulted from a division in compliance with the
Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The parcels
described herein may be sold, leased, or financed without further compliance with the Subdivision Map
Act or any local ordinance enacted pursuant to the Act. Development of the parcels may require issuance
of a permit or permits, or other grant or grants of approval.
This Certificate of Compliance adjusts the lot lines between four existing legal parcels of record and
results in three legal parcels of record. The lot had a single - family residence and detached garage across
the parcel lines and has been demolished to accommodate the lot line adjustment. The lot is addressed
84 East F Street and the Assessor Parcel Number (APN) is 258 - 202- 12 -00. All three parcels are in the
Downtown Encinitas Specific Plan and have zone designations of Residential 11 (D-R-1 1).
The D -R -11 zone in the Downtown Encinitas Specific Plan specifies a minimum net lot area of 5,000
square feet in size. With the lot line adjustments the nonconforming lots will now meet this requirement.
Parcel A, the most westerly lot, will result in a new net lot area of 5,000 square feet, Parcel B, the middle
lot, a new net lot area of 5,000 square feet, and Parcel C, the easterly most lot, a new net lot area of
5,812 square feet.
The adjusted parcels will comply with the Downtown Encinitas Specific Plan Encinitas development
standards of lot area, lot depth, and lot width as well as all setbacks. The boundary adjustment as
proposed meets or exceeds the zoning standards for the D -R -11 zone as well as the City of Encinitas
Municipal Code.
