(Section 66499.35 of the Government Code)
The Development Services Department of the City of Encinitas has determined that the parcels of
real property described below have been divided or have resulted from a division in compliance
with the Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The
parcels described herein may be sold, leased, or financed without further compliance with the
Subdivision Map Act or any local ordinance enacted pursuant to the Act. Development of the
parcels may require issuance of a permit or permits, or other grant or grants of approval.
This Certificate of Compliance adjusts a lot line between two existing legal parcels of record.
Parcel A (APN 260 - 563- 08 -00), addressed 1006 Genie Lane, has a single - family residence and is
adjacent to and west of Parcel B. Parcel B, addressed 1900 Freda Lane (APN 260- 563 -03), also
has a single - family residence. Both parcels are within the Residential 8 (R -8) Zone.
Section 30.16.010 of the City of Encinitas Municipal Code specifies a minimum net lot area of
5,400 square feet for the R -8 zone. The adjustment to Parcel A will result in a new lot area of
11,215 square feet in size and for Parcel B 10,465 square feet in size. The R -8 Zone requires a
minimum lot width of 60 feet and a minimum lot depth of 90 feet. Parcel A provides a width of
81.63 feet and depth of 131.80 feet, and Parcel B provides a width of 70.45 feet and depth of
136.81 feet. Both lots comply with the net lot area and the minimum lot width and depth
standards.
The Residential 8 Zone requires a 25 -foot front yard setback. The existing front yard setback on
Parcel A is 16 feet and Parcel B has 19 feet, less than the 25 -foot minimum standard for the R -8
Zone. These setbacks are considered legal nonconforming and the boundary adjustment will not
increase the nonconformity.
The adjusted parcels, except for the legal nonconformities noted above, will comply with all
Encinitas Municipal Code (EMC) development standards,: including those relating to setbacks, lot
sizes and minimum lot widths, and depths.
