Re Vacation and Abandonment of
a Portion of "C" Street in

ON MOTION of Supervisor Dent, seconded by Supervisor Bird, the
following resolution is adopted by the Board of Supervisors of the County
of San Diego, \State of California*
WHEREAS, on August 71 1962, the Board adopted a resolution declaring
its intention to vacate and abandon the following described county highway
in the County of San Diego, State of California:
All that portion of "C" Street in Encinitas, according to
Map thereof No. 148, filed in the office of the Recorder
of the County of San Diego, lying westerly of the westerly
line of the California State Highway, and lying easterly of
a line drawn from the northwest corner of Lot 1, Block 4.
to the southwest corner of Lot 8, Block 3 of said Encinitas;
and
WHEREAS, the matter came on for hearing before the Board of Supervisors
of San Diego County, California, this 11th day of September, 1962, at
11:00 a.m.; and it appears from the Affidavit of Publication and the
Affidavit of Posting on file in said proceedings that due and proper notice
of said hearing has been given as required by and
WHEREAS, it appears further that no written protests or objections to
said proposed vacation have been filed, and no oral protests or objections
have been made; and
WHEREAS, the Planning commission, in its report filed in the office of
the Clerk of the Board of Supervisors on August 2, 1962, (Document No. 321060),
recommended that said highway be vacated and abandoned; NOW THEREFORE
The Board of Supervisors hereby finds that due and proper notice of
the hearing on the resolution of intention to vacate said highway has been
given as required by law, and that said highway hereinafter described is
unnecessary for present or prospective public use.
IT IS THEREFORE RESOLVED AND ORDERED that the hearing be and it is
hereby closed, and that that certain county highway hereinafter described
be and it is hereby vacated and abandoned:
All that portion of "C" Street in Encinitas, according to
Map thereof No. 148, filed in the Office of the Recorder
of the County of San Diego, lying westerly of the westerly
line of the California State Highway, and lying easterly
of a line drawn from the northwest corner of Lot 1, Block 4,
to the southwest corner of Lot 8, Block 3 of said.Encinitas.
PASSED AND ADOPTED by the Board of Supervisors of the County of
San Diego, State of California, this 11th day of September, 19622 by the
following vote:
AYES; Supervisors Gibson, Bird, Dent and Austin
NOES: Supervisors None
ABSENT: Supervisors None
Supervisor Cozens abstains from voting
