The Residential 3 zone requires a 10 -foot side yard setback. The existing setback on Parcel B is nonconforming in that they have less than the 10 -foot minimum (5 feet on south side). This setback is legal nonconforming and the boundary adjustment will not increase the nonconformity. The adjusted parcels, except for the nonconformity on Parcel B, will comply with the Encinitas Municipal Code (EMC) development standards, for setbacks, lot sizes, minimum widths, and depths.
