(Section 66499.35 of the Government Code)
The Planning and Building Department of the City of Encinitas has determined that the parcels of real
property described below have been divided or have resulted from a division in compliance with the
Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The parcels
described herein may be sold, leased, or financed without further compliance with the Subdivision Map
Act or any local ordinance enacted pursuant to the Act. Development of the parcels may require issuance
of a permit or permits, or other grant or grants of approval.
This Certificate of Compliance adjusts a lot line between two existing legal parcels of record. Parcel A
(APN 264 - 143- 26- 00),"a vacant lo� is adjacent to and north of Parcel B. Parcel B, addressed 1056 Lark
Song Lane (APN 264 - 143- 27 -00), a single - family house, a pool and cabana. Both parcels have a zone
designation of Rural Residential 2 (RR -2) zone.
Section 30.16.010 of the City of Encinitas Municipal Code specifies a minimum net lot area of 21,500
square feet (0.5 acres) for the Rural Residential 2 (RR -2) zone. The adjustment to Parcel A will result in a
new lot area of 29,448 net square feet and for Parcel B a new net lot area of 23,061 square feet.
The adjusted parcels will comply with the Encinitas Municipal Code (EMC) development standards for lot
depth and width. There is no development proposed for Parcel A but Parcel B has a single - family
residence, a pool and cabana on site. All structures on Parcel B will meet the required setbacks for the
RR -2 zone.
