IN COMPLIANCE:
The Planning & Building Department of the City of Encinitas has determined that the parcels of real
property described below have been divided or have resulted from a division in compliance with the
Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The parcels
described herein may be sold, leased, or financed without further compliance with the Subdivision Map
Act or any local ordinance enacted pursuant to the Act. Development of the parcels may require issuance
of a permit or permits, or other grant or grants of approval.
This Certificate of Compliance confirms two existing legal lots of record. The underlying lots as described
herein (Exhibit "A") have been divided into two separate lots per San Diego County Map No. 187. The
lots were lawfully approved through the County of San Diego.
Both underlying lots are located within the Residential 11 (R-11) zone where the minimum lot area
requirement is 3,950 square feet with the minimum lot dimension requirements of 40 feet in width and
100 feet in depth. Both existing lots comply with the Residential 11 (R-11) lot sizes and dimensions.
Lot 13 (129 & 131 Fifth Street) and Lot 12 (133 & 135 Fifth Street) are currently developed with one
duplex on each lot for a total of four units. The two existing duplex structures meet all of the R-11 setback
requirements for the front, rear and side yards. An existing 130 square-foot carport storage plus carport
overhang is located within the rear yard setback of Lot 12. The structure is nine feet tall. Lot 13 also
includes a carport overhang within the rear yard setback. Both structures are permitted within the rear
yard setback pursuant to Encinitas Municipal Code section 30.48.0406.
