1919-09-02 TINUTF:S OF A REGULAR YMTING OF THE BOl'.RD OF DIRECTORS OF THE CARDIFF IRRIGATION DISTRICT , HELD AT THE OFFICE 4, OF THE DISTRICT IN THE FLATIRON BUILDING IN THE TOWN OF CARDIFF, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ON TUESDAY, SEPTFJ!eER 2, 1919 , AT THE HOUR OF 2 O' CLOCK P. Y. The meeting was called to order by the President who ordered roll call of the directors present. Those responding to -aid roll call were: Director `". E. Hyer, Director J. Frank Cullen, Director Chester A. Craig, Director Warner Rathyean end Director Fred L. Cole. The minutes of the previous regular meeting of August 5, 1919, were read and approved as read. Borden and Edwin R. Borden for the exclusion of the lands described in their petition from the Cardiff Irrigation Dis- trict, a motion was made by Director CHester A. Craig and seconded by Director Fred L. Cole that the following Resolution be adopted: RESOLUTION 2,0. E A RESOLUTION EXLUDING LANDS FROM THE CARDIFF IRRIGATION DISTRICT. ",'=EAS, a petition in writing signed by Charles Kelley, Irwin Kelley J. Kelley, Robert J. Kelley, F. Jane Pritchard, Minnie L. Borden and Edwin R. Borden, was filed with this Board on the 4th day of lrarc�c, 1919, praying that their lands be excluded from the Cardiff Irrigation District, and LS'HEREAS, the Secretary of the Board of Directors of the Cardiff Irrigation District caused a notice of the filing of said petition and the date of the hearing on the same to be posted and published as pro- vided by law; and -11EREAS, a hearing was had on said petition and the objections thereto on the 6th day of Yay, 1919, and Whereas, a. further hearing on said petition and the objections thereto was duly and regularly con- tinued to the 3rd day of June, 1919 ; and whereas, on the said 3rd day of June, 1919, a further hearing on said petition and the objections thereto was duly and regularly continued to July 1, 1919, and whereas, July 1, 1919, was an election day and a legal holiday., the meeting of the Board of Directors or. s,7id day was adjourned to meet Wednesday, July 2, 1919; and whereas, on said date of July 2, 1919, a further hearing on svid petition and the objections theretd was duly and regu- larly continued to the 5th day of August, 1919, end whereas, on the said 5th day of August, 1919, a further hearing on said petition was on said 'ay and date continued to the 2nd day of September, 1919 ; and LOW, r,MEREAS, said matter is now before this Board for further hear- ing; and whereas, this Board has duly ascertained that said petition complies with all of the sts;tutory requirements in conformity with the California Irrigation District Act ; and whereas, on this day and date and at the time to which the farther hearing of said matter was contin- ued as afordsaid, this Board proceeded to and did further hear the said petition and the objections thereto ; and WHEREAS, this Board has fully considered the said petition and the prayer thereof and has fully considered all of the objections in writing thereto and has heard and fully considered all of the argyments and reasons made or offered to be made by all of said petitioners, why said lands should be excluded from said District, and all objections thereto, and is now fully advised in the premises and is ready to act upon the said petition and the objections to the same ; O l e N 0 VT T H E R E F O R E , BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CAM FF IRRIGATION DISTRICT, AS FOLLOVIS, TO-"7IT: - 1. That all the matters and things hereinbefore recited are true; that the petition filed by Charles Kelley, Irwin J. Kelley, Robert J. Kelley, F. Jane Kelley Pritchard, D?,nnie L. Borden and Edwin R. Borden, the owners in fee of those certain tracts of land described in said pet- ition which constitute a portion of the Cardiff Irrigation District, praying that such tracts of land be excluded and taken from said District , states the grounds and reasons upsn which it is claimed that such lands should be excluded, and describes the boundaries of the lands of each petitioner which are included within such boundaries and is acknowledged in the manner and form as required by law. 2. That due notice of the filing of such petition and a hearing thereon was given in the manner and form as required by law. 3. That each and all of the objections to said petition are without merit. 4. That the facts set forth in said petition are true; that owing not to the typographical location of said properties, it would/be feasible r to irrigate the said laude under the system of works contemplated to be installed by the said District. 5. That it is for the best interest of the Cardiff Irrigation Dis- trict that the boundaries thereof be changed so as to exclude the lands in said petition described. Frank Cullen voting "yes, " Director War- ner Rathyen voting "yes, " Director Chester A. Craig refusing to vote, Director Fred L. Cole voting "yes. " 11 motion was made by Director Fred L. Cole and seconded by Director Chester A. Craig that the petition of iilexander Beller, praying that his land be excluded from the Cardiff Irrigation District, be laid on the table until the next nregular meeting to be held on Tuesday, the 7th day of October, 1919. President ordered the roll call with the following result: Director 7. E. Hyer voting "yes", Director J. Frank Cullen voting"yes" Director Chester A. Craig voting "yes, " Director ^7arner Rathyen � oting "yes, " and Director Fred L. Cole noting "yes." A petition demanding an election be hald for the recall and election of Director J. Frank Cullen, from Division NO. 2 of the Car- diff Irrigation District, duly certified by the Secretary as having the required number of signatures attached thereto, was read and or- dered filed. A petition demanding the recall and an election to be held for the recall of Director Chester 1i. Craig of 1ivision No.4, duly certified to by the Secretary as having the required number of signa- tures attached thereto, was read and ordered filed. A motion was made by Director Fred L. Cole and seconded by Director Chester A. Craig, that when the present meeting adjourns, said meeting be adjourned to meet Wednesday, September 17 , 1919, at two o '- clock P. M. , to take action on the petitions demanding the recall and F election of successors to Directors J.Frank Cullen, Chester A. Craig, �t and Fred L. Uole. The President ordered the roll call with the fol- lowing result, Director °. E. Hyer voting "no, " J. Frank Cullen voting "yes, " Director 'earner Rathyen voting "no, " Director Chester A. Craig voting "yes, " and Director Fred L. Cole voting "yes. " The reports of the Treasurer and TaX Collector were duly sub- mitted, examined, approved and ordered filed.
