IN COMPLIANCE:
�\ The Planning and Building Department of the City of Encinitas has determined that the parcels of real
property described below have been divided or have resulted from a division in compliance with the
Subdivision Map Act and with the provisions of the City of Encinitas Municipal Code. The parcels
described herein may be sold, leased, or financed without further compliance with the Subdivision Map
Act or any local ordinance enacted pursuant to the Act. Development of the parcels may require issuance
of a permit or permits, or other grant or grants of approval.
This Certificate of Compliance adjusts two lot lines between two existing legal parcels of record. Parcel A
(APN 262-073-07-00), a vacant lot, is adjacent to and west of Parcel B. Parcel B, addressed 3788
Manchester Avenue (APN 262-073-08-00), contains a horse barn and associated sheds. The purpose of
the project is so Parcel B can maintain access to the property. Both parcels have a split zone designation
of Rural Residential (RR) zone and the Rural Residential Floodplain (RRFP) zone.
Parcels in the Rural Residential (RR) / Flood Plain (RRFP) are required to have eight net acres in lot
area. Existing net acreages for both parcels do not meet the density net acreage required and with the lot
line adjustment, the resulting net acreage will be the same as prior to the adjustment. Therefore, the lot
line adjustment does not expand and/or intensify the nonconformity.
The adjusted parcels will comply with the Encinitas Municipal Code (EMC) development standards for lot
depth and width. There is no development proposed with the lot line adjustment but there are some
existing structures, including a horse barn and sheds that were constructed prior to the City's
Incorporation. These structures meet the current setbacks regulations but are accessory uses on an
otherwise vacant lot.
