A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,
CALIFORNIA, APPROVING THE CONTINGENT VACATION OF PUBLIC
ROAD RIGHT-OF-WAY AT THE TERMINUS OF VILLAGE SQUARE
DRIVE
WHEREAS, TRC Encinitas Village, LLC submitted an application to vacate a portion of
public road right-of-way at the terminus of Village Square Drive, in the City of Encinitas and
WHEREAS, the vacation proceedings are conducted under Chapter 3 of Part 3 of the State
of California Streets and Highway Code and
WHEREAS, On December 6, 2011, City staff distributed notices to residents within 500
feet of the proposed vacation and to all public utility companies and
WHEREAS, The street vacation was advertised in the Coast News on January 6, 2012 and
on January 13, 2012 and
WHEREAS, the City Council of the City of Encinitas on January 25, 2012, heard all
persons interested in the proposed vacation at 6:00 p.m. in the City of Encinitas Council Chambers,
505 South Vulcan Avenue, Encinitas, CA 92024
NOW BE IT THEREFORE RESOLVED that the City Council of the City of Encinitas,
has adopted the Resolution to vacate a portion of public right-of-way at the terminus of Village
Square Drive, in the City of Encinitas per Attachment A and Attachment B and in accordance with
the following:
I. A private road will be extended through the vacated right-of-way to provide access
to Village Square shopping center.
2. The City of Encinitas will reserve a public utility easement and a public sewer and
water easement over the vacated area.
3. The project as proposed complies with the California Environmental Quality
Act since it is exempt from environmental review pursuant to Section 15061 (B) (3)
of the CEQA Guidelines,
4. This vacation will be contingent on the approval and acceptance of a private access
and parking improvements to the satisfaction of the Engineering Department.
RESERVING AND EXCEPTING from vacation and abandonment all existing private
and public easements other than easements specifically vacated hereon.
PASSED AND ADOPTED this 25th day of January, 2012, by the following vote, to wit:
AYES: Barth, Bond, Gaspar, Muir, Stocks.
NAYS: None.
ABSENT: None.
ABSTAIN: None.
