The Planning and Building Department of the City of Encinitas has determined that the parcel of real property described below has been divided or has resulted from a division in compliance with the Subdivision Map Act and with provisions of the City of Encinitas Municipal Code The parcel described herein may be sold, leased, or financed without further compliance with the Subdivision Map Act or any local ordinance enacted pursuant to the Act. Development of the parcel may require issuance of a permit or permits, or other grant or grants of approval. This Certificate of Compliance adjusts the boundaries of the underlying parcels A and B located at 2423-2425 5"' Street. Parcel A is located within both the Rural Residential 2 (RR-2) and the Rural Residential Floodplain (RRFP) zones. Parcel B is located within the RRFP zone. The adjusted boundaries of Parcels A and B will follow the zoning boundary lines, which will result in Parcel A being located entirely in the RR-2 zone and Parcel B in the RRFP zone. A single family home and horse farm exist on-site and will remain. The adjusted parcels will comply with the Encinitas Municipal Code (EMC) development standards of lot depth and width as well as front and side yard setbacks. Parcel A complies with the rear yard setback where Parcel B includes existing structures located within the rear yard setback. The employee housing structure encroaches 1.5 feet into the rear yard setback. In addition, a Hay Shed and Equipment Shed are located within 14 feet and 5 feet respectively from the property line These structures are identified on the County of San Diego Residential Building Records as existing and therefore are legal non-conforming. Legal non-conforming structures shall be subject to EMC Chapter 30.76, Nonconformities. No modifications are proposed to these structures. The proposed net lot area for Parcel A complies with the required net lot area of the RR-2 zone of 14,500 square feet. Zone RRFP's required net lot area is 8 acres. The proposed net lot area for Parcel B is 11.31 acres and is in compliance with net lot area. Due to the floodway, Parcel B's existing net acreage does not meet the density net acreage required. However, Parcel B existed prior to City of Encinitas incorporation and therefore is legal non-conforming. Pursuant to EMC Section 30.76.050, the adjusted boundary will not increase the net acreage inconsistency.
