RESOLUTION NO. 2012-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS, CALIFORNIA,
APPROVING THE CONTINGENT VACATION OF PUBLIC ROAD RIGHT-OF-WAY ON
PUEBLA STREET.
WHEREAS, Shea Homes submitted an application to vacate public right-of-way on Puebla.
Street (east of Saxony Road), in the City of Encinitas and
WHEREAS, the vacation proceedings are conducted under Chapter 3 of Part 3 of the
State of California Streets and Highway Code and
WHEREAS, On September 24, 2012, City staff distributed notices to residents within 500
feet of the proposed vacation and to all public utility companies and
WHEREAS, the street vacation was advertised in the Coast News on October 19, 2012
and on October 26, 2012 and
WHEREAS, the City Council of the City of Encinitas on November 14, 2012, heard all
persons interested in the proposed vacation at 6:00 p.m. in the City of Encinitas Council
Chambers, 505 South Vulcan Avenue, Encinitas, CA 92024
NOW BE IT THEREFORE RESOLVED that the City Council of the City of Encinitas, has
adopted the Resolution to vacate a portion of public right-of-way on Puebla Street, in the City of
Encinitas per Exhibit "A" in accordance with the following:
1. The City of Encinitas will reserve the following easements over the vacated right-
of-way as shown in Exhibit "B".
A. 10' wide public maintenance and maintenance vehicles access
easement.
B. 24' wide public sewer and water easement, and public emergency
access easement.
C. 12'wide public utility easement.
D. 20'wide water easement.
E. a general utility and pedestrian access easement.
2. This vacation will be contingent on the approval and acceptance of the
construction of the cul-de-sacs at the end of Eugene Avenue and Passiflora
Avenue to the satisfaction of the Engineering Department.
3. The project as proposed complies with the California Environmental Quality
Act since it is exempt from environmental review pursuant to Section 15061 (B) (3)
of the CEQA Guidelines.
RESERVING AND EXCEPTING from vacation and abandonment all existing private and
public easements other than easements specifically vacated hereon and all reserved easements
listed above and shown in Exhibit"B".
PASSED AND ADOPTED this 14`h day of November, 2012, by the following vote, to wit:
AYES: Barth, Bond, Gaspar, Muir, Stocks,
NAYS: None.
ABSENT: None.
ABSTAIN: None.
