THIS AGREEMENT is made this 28 day of August, 1979, in Rancho
Santa Fe, California, by and between ARTHUR E. MEYERHOFF, ELAINE MEYERHO,
and JUDITH LYNN MEYERHOFF, as joint tenants, (hereinafter collectively
referred to as "GRANTEES") and DONALD J. SOLKS, THOMAS N. ARRIETA and
MARILYN K. ARRIETA, LOUIS HUSZAR, JR., and JAMES TEETER (hereinafter collec-

tively referred to as "GRANTORS"):
WHEREAS, the GRANTEES are the owners in fee simple of that certain
parcel of real property located in the County of San Diego, State of California,
described as Lot 2, Section 4, Township 13 South, Range 3 West, San Bernardino
Meridian (hereinafter "the premises").
WHEREAS, the GRANTEES are desirous of obtaining a road easement and
right of way for road and public utility over, under, along and across those
portions of Parcel Map No. 8278, lying within the area delineated and designated
on said parcel map as "proposed 60.00 foot private road easement" (hereinafter
"Road Easement and Right of Way") to service the premises. A copy of Parcel
Map No. 8278 is attached hereto as Exhibit "A" and incorporated hereat by
reference.
WHEREAS, the GRANTORS are the fee owners of the real properties, which

shall be encumbered and will become the servient estates, upon the granting '
of the Road Easement and Right of Way unto GRANTEES. `

WHEREAS, the GRANTORS are willing to grant unto GRANTEES the Road
Easement and Right of Way on the following terms and conditions:
1. That the GRANTORS, in consideration of the payment of the
sum of Two Thousand, Five Hundred Dollars ($2,500.00) lawful money of the

United States, paid to them by GRANTEES, the receipt of which is hereby ack-
nowledged, grant, bargain, sell and convey to the GRANTEES the Road Easement
and Right of Way above described.
This instrument filed for record by California World Title
as an accomodation only,It has not been examined as to
its execution or as to its effect upon the title,

2. Said Road Easement and Right of Way shall be an easement
appurtenant running with the land and thereby benefitting the premises and
burdening the real properties owned by GRANTORS, and each of them. Further,
this Agreement shall run with the land of GRANTEES and GRANTORS and shall be s .
binding on and shall inure to the benefit of the parties, their heirs, suc-
cessors, legal representatives, and assigns.
3. In the event the County of San Diego shall require addi-
tional construction improvements during the course of said County's inspection
of the road within the Road Easement and Right of Way, then JAMES TEETER, agent
of GRANTORS, is to receive written notice of such additional requirements and
is to be afforded a reasonable opportunity to negotiate with the County of San

Diego and the contractor to waive such additional requirements. However, that
in the event said County requires a sixty foot (60') road easement, then
GRANTEES shall have the right to complete any reasonable and necessary improve-
ments, provided that the existing culverts are to remain functionable and such
additional improvements are of comparable quality as the existing improvements.
IN WITNESS WHEREOF, the parties execute this Agreement on the date
above stated.
