RESOLUTION VACATING AND ABANDONING
EXCESS RIGHT-OF-WAY OF A COUNTY HIGHWAY s
ON MOTION of Supervisor Hedgecock, seconded by Supervisor Moore the
following resolution is adopted:
1111EREAS, Mr. Jerry Peters has requested the vacation of the hereinafter des-
cribed portions of County highways (Document No. 577966 ); and x
WHEREAS, Section 960.1 of the Streets and Highways Code, provides that the
Board of Supervisors of any County may retain or may summarily vacate and abandon ! ,
any portion of a County Highway which portion is excess right-of-way and not required Q
for said highway; and
WHEREAS, the County Planning Commission has recommended said portions of f ;
County highways be vacated (Document No. 577966 ); and
WHEREAS, it appears to this Board that said portions of County highways as a is
recommended for vacation by said Commission are not needed for present or prospec-
tive use as County highways; NOIV THEREFORE
IT IS FOUND, DETERMINED, AND DECLARED that the right-of-way to be vacated '' h
cannot be used as a non-motorized transportation facility, and that the Proposal
is not subject to the environmental impact review process; ACCORDINGLY, ( ' rn
BE IT RESOLVED that this Board of Supervisors finds that the hereinafter
described portions of County highways are excess right-of-way and not required for
said highway. 41(
BE IT FURTIIER RESOLVED that the hereinafter described portions of County
highways be and are hereby vacated and abandoned:
Parcel No. 78-1442-A1 Iz Z
The Easterly 10.00 feet of Fourth Street, 80.00 feet wide, adjacent to Lots
15 and 16, Block 31, Encinitas, Map No. 148, filed in the Office of the County {
Recorder of the County of San Diego, State of California, and the Southerly �q '
10.00 feet of "F" Street, 80.00 feet wide, adjacent to said Lot 16.

EXCEPTING that portion of said Fourth Street and "F" Street lying Northwesterly
of the arc of a 20.00 foot radius curve concave Southeasterly and tangent to
the lVesterly line of said Easterly 10.00 feet of Fourth Street and tangent
to the Northerly line of the said Southerly 10.00 feet of "F" Street.

fixtures for the operation of gas pipe lines, telegraphic and telephone lines andrl
