The undersigned Grantor(s) hereby grant(s) to THE PACIFIC TELEPHONE AND TELEGRAPH COMPANY, Grantee, its successors and assigns, an
easement to construct and maintain (place, operate, inspect, repair, replace and remove) such underground communication facilities as Grantee may
from time to time require (including ingress thereto and egress therefrom) consisting of wires, rabies, conduits, manholes, handholes and aboveground
markers, pedestals, terminal equipment cabinets, other associated electrical conductors and necessary fixtures and appurtenances in, under and upon
that certain real property in the County of San Diego
State of California, described as:
That portion of the Southeast Quarter of the Northwest Quarter of Section 14,
Township 13 South, Range 4 West, S.B.M., County of San Diego, State of California,
according to the official plat of said land filed in the District Land Office, describ d
in deed filed for record at File /Page No. 77- 330215, on the 15 day of August,
1977, in the Office of the County Recorder of San Diego County.
The above described easement shall be located on a strip of land twelve (12.00)
feet in width in said property lying Easterly of and coincident with the
following described line:
Beginning at the Northeast corner of said Section 14; thence South 70032'11"
West, 3727.33 feet to the TRUE POINT OF BEGINNING; said point being the beginning
of a non - tangent curve concave to the East having a radius of 1170.00 feet and
to which beginning a radial line bears North 89035'44" West; thence Southerly
202.31 feet along said curve through a central angle of 09°54126 "; thence South
09030'10" East, 60.00 feet more or less to the POINT OF TERMINATION in the
Northerly right of way line of Encinitas Boulevard.
This deed is given and accepted upon the understanding and upon the condition that
in the event the above described property or any portion thereof is dedicated for
public street purposes, the easement herein conveyed shall immediately terminate as
to that portion of said property so dedicated but shall remain in full force and
effect as to that portion of said property, if any, which is not so dedicated.
Grantee shall be responsible for damage caused intentionally or by any negligent act or omission of Grantee, its agents or employees while exercising the
