RESOLUTION NO. 2014-05
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,
CALIFORNIA,APPROVING THE CONTINGENT SUMMARY VACATION OF A
PORTION OF RIGHT-OF-WAY LOCATED AT 637 AND 633 SPARTA DRIVE
WHEREAS, James R. O'Donnell and George Bennett, Jr. submitted an application to
vacate a portion of unused road right-of-way located at 637 and 633 Sparta Drive, in the City of
Encinitas and
WHEREAS, the vacation proceedings are conducted under Chapter 4 of Part 3 of the State
of California Streets and Highway Code and
WHEREAS, on December 9, 2013, City staff distributed notices to residents within 500
feet of the proposed vacation and to all public utility companies and
WHEREAS, the City Council of the City of Encinitas on January 22, 2014, heard all
persons interested in the proposed vacation at 6:00 p.m. in the City of Encinitas Council Chambers,
505 South Vulcan Avenue, Encinitas, CA 92024
NOW BE IT THEREFORE RESOLVED that the City Council of the City of Encinitas,
has adopted the Resolution to summarily vacate a portion of unused road right-of-way located at
637 and 633 Sparta Drive, in the City of Encinitas and in accordance with the following:

1. The project as proposed complies with the California Environmental Quality
Act since it is exempt from environmental review pursuant to Section 15061 (B) (3)
of the CEQA Guidelines,
2. There is no present or prospective public use identified for the unused portion of
right-of-way located at 637 and 633 Sparta Drive.
3. This vacation will be contingent on the following conditions:
The San Dieguito Water District will require that water meters be located in front of
the parcel they are serving and outside of any existing or proposed travel way and
adjacent to the proposed new right-of-way. Cost of the relocations are the
responsibility of the applicants and work shall be completed by District forces.
Appurtenances shall not be placed in roadside ditches.
The Applicants contractor will need to re-connect the private water laterals after
District forces have relocated the Applicant's water meters.
The Applicants will be required to provide construction staking of the new right-of-
way line to allow for the relocation of San Dieguito Water District facilities.
RESERVING AND EXCEPTING from vacation and abandonment all existing easements
pertaining to said property. A General Public Utility Easement will be reserved over the entire
vacated area.
PASSED AND ADOPTED this 22nd day of January, 2014,by the following vote,to wit:
AYES: Barth, Gaspar, Kranz, Muir, Shaffer.
NAYS: None.
ABSENT: None.
ABSTAIN: None.
