EXHIBIT A
A non- exclusive easement and right -of -way for roadway purposes
and utilities and appurtenances thereto over, under, along
and across:
That portion of Block 92 of Colony Olivenhain, in the County
of San Diego, State of California, according to map thereof
No. 326, filed in the Office of the County Recorder of said
County and described in Parcel 1 of a deed to Spencer A. Smith,
Jr., recorded July 24, 1974 as file page No. 74- 198973 in the
Office of said County Recorder and more particularly described
as follows:
Begining at the most westerly corner of the above described
Parcel 1; thence along the Southerly line thereof South 72 °52139'
East, 37.03 feet; thence leaving said southerly line North
15 118116" East, 35.50 feet to a tangent 48.00 foot radius curve
concave Northwestly; thence Northerly along the arc of said
curve through a central angle of 76 146'05 ", a distance of 66.31
feet; thence non - tangent to said curve South15 118116" West, a
distance of 81.05 feet to the point of begining.
GRANTOR hereby further grants to GRANTEE the privilege and right
to extend drainage structures and excavation and embankment
slopes beyond the limits of the herein described right -of -way
where required for the construction and maintenance of said
roadway.
GRANTOR hereby further grants to GRANTEE all trees, plants
(growing or that may hereafter grow) and road building materials
within said right -of -way, including the right to take water,
together with the right to use the same in such manner and at
such locations as said Grantee its successor or assigns may
deem proper, needful or necessary, in the construction, recon-
struction, improvement or maintenance of said roadway.
GRANTOR, for itself, its successors and assigns, hereby waives
any claim for any and all severance damages to GRANTOR'S
remaining property contiguous to the right -of -way hereby con-
veyed by reason of the location, construction, landscaping, or
maintenance of said roadway.
This easement and right -of -way is for the benefit of and hereby
made appurtenant to GRANTEE'S adjacent property and any future
division thereof.
GRANTOR hereby grants to the GRANTEE, its successors and assigns
the right to have and to hold said easement and right -of -way
forever; TOGETHER with the right to convey said easement and
right -of -way, or any portion thereof, and all other rights
herein conveyed in the form of an easement or an irrevocable
offer to dedicate real property, to any public agency for
public purposes.
