Crumley, et al, recorded September 20, 1982, as File /Page No. 82- 290955 in said Recorder's Office, lying within a 102.00 foot wide strip of land, the sidelines of said strip lying 51.00 feet on each side of the centerline of Road Survey No. 1788 (Encinitas Boulevard) as said centerline is described in Parcel 65079A of deed to said County, recorded September 23, 1965 as File /Page No. 172922 in said Recorder's Office. EXCEPTING therefrom that portion thereof lying Westerly of Westerly boundary of the following described land: Commencing at the centerline intersection of Road Survey No. 1788 (Encinitas Boulevard) and Vulcan Avenue being Engineer's Station 7 +11.22 of said Road Survey No. 1788 as described in said Parcel 65079A; thence along said centerline of Encinitas Boulevard, North 85 °40'19" East, 359.82 feet to the beginning of a tangent curve concave Southerly having a radius of 1000 feet; thence Easterly along the arc of said curve through a central angle of 19 °18'38" a distance of 337.03 feet; thence South 75 °01'03" East, CCSF, 85.25, 5/77 1677 Parcel No. 83- 0355 -8 (Cont.) 202.93 feet to a point in the Easterly line of said East Block 3 and said Map No. 148; thence leaving said centerline along said Easterly line, South 02 017'30" West, 47.15 feet to a point in the Southerly right -of -way line of said Road Survey No. 1788; thence along said Southerly right -of -way line, North 75 °01'03" West, 70.00 feet to the TRUE POINT OF BEGINNING; thence leaving said Southerly right -of -way line, South 14 058'57" West, 3.00 feet; thence North 77 °42'29" West, 330.74 feet to said Southerly right -of -way line of said Road Survey No. 1788; thence Easterly along said Southerly right -of -way line to the TRUE POINT OF BEGINNING. t M ' - 1678 r The Grantor hereby further grants to the County of San Diego the privilege and right to extend drainage structures and excavation and embankment slopes beyond the limits of the herein described right -of -way where required for the con- struction and maintenance of said County Highway. RESERVING unto grantor of the above described parcel of land, his successors or assigns, the right to eliminate such slopes and /or drainage structures or portions thereof, when in the written opinion of the County and /or District Engineer of Grantee, the necessity therefore is removed by substituting other protection, support and /or drainage facility, provided such substitution is first approved in writing by said Engineer(s). The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road building materials within said right -of -way, including the right to take water, together with the right to use the same in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction, reconstruction, improvement or maintenance of said highway. The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all damages to Grantor's re- maining property contiguous to the right -of -way hereby conveyed by reason of the loci# on, onstruction, landscaping or maintenance of said highway. ay STATE OF County of } SS.
