For and in consideration of a valuable consideration
gs HEREBY GRANT to the City of San Diego, a municipal corporation, in the
County of San Diego, State of California, the Santa Fe Irrigation District,
and the San Dieguito Irrigation District as tenants in common, the per -
manent easement and right of way to construct, reconstruct, maintain,
E. operate and repair one or more water mains including any or all appurtenances
thereto, together with the right of ingress and egress, over, under, along
and across all that real property situated in the County of San Diego, State

All that portion of Section 159 Township 13 South, Range 3
West, San Bernardino Base and Meridian, being more particularly
- described -as a strip of land 30.00 feet in width lying 7.50
feet to the left and 22.50 feet to the right, looking in the
direction of the traverse, of the following described lines
Beginning at the North Quarter corner of Section 15, Township
13 South, Range 3 West, San Bernardino Base and Meridian; thence
North 89 037116" West, along the North line of said Section, a
distance of 9.02 feet to the TRUE POINT OF BEGINNING; thence
South 45011119" West a distance of 124.97 feet to the beginning
of a tangent curve concave Northerly, with a radius of 365.00
feet; thence Southwesterly along said curve through a central
angle of 32058150" a distance of 210.10 feet; thence South
78010109" West a distance of 403.48 feet to the beginning of a
tangent curve concave Southerly, with a radius of 1050.00 feet;.

The sidelines of the above strip shall be prolonged or shortened,
•so as to terminate in said Northerly and Westerly lines of said
Section 15, Township 13 South, Range 3 West, San Bernardino Base
and Meridian.
It is mutually understood and agreed by the parties hereto that in
the event the.said party of the 2nd part fails to install and
place main water pipeline in service as hereinabove provided across
the above described real estate on or before the first day of July
1965; then this agreement of easement shall cease and become void.
it- is also mutually understood and agreed by the parties hereto
that in the event the said party of the 2nd part: fails to install
ir the secondary pipelines required for a proposed filter plant within
ten years of the recording of this easement document, then the
Northwesterly fifteen (15) feet of the above described thirty. (30)
foot easement shall revert to the party of the first part and the
agreement o �easemant over this portion of the.right of way shall

cease and become void.
The Grantor reserves the right of continued surface use of the
right of way and the right to install pipelines or cords over or
along the right of way provided that good engineering practices

are followed and that notification of any construction is given
to the City of San Diego Utilities Department prior to construction. i

t.} Grantees of said easement, agree at their sole expense to place or
relocate in or as near the present location as practicable the i
Vinstallations now upon the right -of way hereby granted*
Grantees agree to remove at their sole expense all excess dirt,
rock, sand or gravel which may be excavated and remain after the
installation and refilling of the pipelines or pipelines ditch,
and to take such other steps as are required to restore the
surface of said right of way as nearly as possible to its present
I condition;
It is agreed that all expenses of Title search and any and all
expenses of such nature in connection with the Recording of this
instrument and Title,__Company charges in connection therewith
shall -be borne by the Grantees.
Reserving unto the +Grantor herein, his heirs and assigns the continued use
of the above described parcel of land subject to the following conditions.
The erecting ik; buildings, masonry walls, masonry fences and other structures;
and the chan�iLhg of the surface grade; shall be prohibited except by written
permission fiV the City of San Diego.
