into a lien covenant for the benefit of the San Dieguito Water District. The "Lien Covenant
Regarding Real Property: Improvements Required as Condition on Final Approval of Development
of Real Property", was recorded with the County Recorder. of the County of San Diego as
Document No.2002-0846219 on October 1, 2002. The Covenant detailed the requirements for the
construction and installation of a public water main and appurtenances, within the property located
along Ocean Bluff Way, Encinitas, CA.
2. Said Covenant, including the plans and specifications for said improvements, is on file in the
Office of the Clerk of the Board of Directors.
3. Said improvements were completed by the owners and accepted by the San Dieguito Water
District Board of Directors on the 23th day of January, 2008.
4. The Encinitas Group LLC, The Woodson Group, LLC, and Stephen H. Dawe, posted
Cash Security in the amount of $ 8,600 and a Bond in the amount of $25,800. The bond amount of
$25,800 may be released at this time. The District will retain Cash in the amount of $8,600 which
shall be released at the end of the one-year warranty period.
5. All requirements of said Agreement have hereby been satisfied except for warranty.
6. Neither acceptance of said improvements by the Board of Directors nor this Notice
constitute a waiver of any defects in the work of the construction or installation of said
improvements.

SUBJECT: Consideration of Acceptance of Public Water Improvements and Authorization to
File a "Notice of Completion" 'for Improvements Constructed by The Encinitas
Group LLC, The Woodson Group, LLC, and Stephen H. Dawe, for Property
Located along Ocean Bluff Way, Encinitas. (APN: 258-140-35, 36, 46, & 47)
BACKGROUND: On October 1, 2002, The Encinitas Group LLC, The Woodson Group,
LLC, and Stephen H. Dawe, owners of property known along Ocean Bluff Way, entered into a
"Lien Covenant Regarding Real Property: Improvements Required as Condition on Final Approval
of Development of Real Property" for the benefit of the San Dieguito Water District. The
Covenant detailed the requirements for the construction of public water improvements. The
developer has completed the construction of the public water improvements and has submitted "As-
Built" drawings to the District.
ANALYSIS: The public water improvements were constructed in accordance with District
approved plans and specifications, under District inspection. A 25% retention of security will be
held for one year to cover warranty of potable water improvements.
FISCAL AND STAFF IMPACTS: Future expenses will be incurred by the District for
maintenance of the new water improvements. Funds to cover the cost of said maintenance are
collected through the sale of water.
RECOMMENDATION: Accept the public water improvements and authorize the General
Manager or his designee to file a "Notice of Completion" for improvements constructed by The
Encinitas Group LLC, The Woodson Group, LLC, and Stephen H. Dawe, for the property
located along Ocean Bluff Way, Encinitas.
