SOMMERS DEVELOPMENT CORP., a California.corporation, and
AMOS SOMMERS, a married man as his sole and separate property
hereinafter called GRANTORO%, do(es) hereby grant,convey and dedicate to the COUNTY OF SAN DIEGO, State of
California, hereinafter called GRANTEE, the right of way and incidents thereto for a public highway upon, over and
across that certain real property in the County of San Diego, State of California, described as follows:
Parcel No. 85- 0005 -A (1 -4 -85) (TRF:JA:etm)
That portion of the Southeast Quarter of the Northwest Quarter of Section 14, Township 13
South, Range 4 West, San Bernardino Meridian, in the County of San Diego, State of California,
according to United States Government Survey, lying within a strip of land 84.00 feet wide,
the sidelines of said strip lying 42.00 feet on each side of the following described centerline:
BEGINNING at a point on the centerline of Clipper Avenue distant South 89 010'31" East, 186.01
feet from the Southwesterly corner of Lot 174 of County of San Diego Tract No. 3474 -3, Map
No. 10140, filed in the Office of the County Recorder of said County, said point being on the
arc of a 1200.00 foot radius curve concave Easterly, a radial line to said point bears North
89 °35'06" West; thence Southerly along the arc of said curve through a central angle of
09 055'04 ", a distance of 207.72 feet; thence tangent to said curve South 09 030'00" East to a
point on the centerline of Road Survey No. 458 -66, according to Map thereof filed in the Office
of the County Engineer of said County, said point being the POINT OF TERMINUS.
The sidelines of said 84.00 foot wide strip of land shall be lengthened and /or shortened so
as to terminate Northerly in the Northerly line of the Southeast Quarter of the Northwest
Quarter of said Section 14, and Southerly in a line that is 51.00 feet Northerly of and concen-
tric with the centerline of Encinitas Boulevard as shown on said Subdivision Map No. 10140.
TOGETHER with that portion of said Southeast Quarter of the Northwest Quarter lying Easterly
of the Easterly line of said 84.00 foot wide strip of land AND lying Northerly of a line that
is 51.00 feet Northerly of and concentric with the centerline of said Encinitas Boulevard AND
lying Southwesterly of the arc of a 20.00 foot radius

curve concave Northeasterly, said curve being tangent to both said Easterly line of
said 84.00 foot wide strip of land and to said Northerly line that is 51.00 feet
Northerly of and concentric with the centerline of said Encinitas Boulevard.
ALSO TOGETHER with that portion of said Southeast Quarter of the Northwest Quarter
lying Westerly of the Westerly line of said 84.00 foot wide strip of land AND lying
Northerly of a line that is 51.00 feet Northerly of and concentric with the center-
line of said Encinitas Boulevard AND lying Southeasterly of the arc of a 20.00 foot
radius curve concave Northwesterly, said curve being tangent to both said Westerly
line of said 84.00 foot wide strip of land and to said Northerly line that is 51.00
feet Northerly of and concentric with the centerline of said Encinitas Boulevard.
Excepting therefrom that portion of Clipper Avenue as shown on said Map No. 10140
lying within said Southeast Quarter of the Northwest Quarter of Section 14.

The Grantor hereby further grants to the County of San Diego the privilege and right to extend drainage structures and
excavation and embankment slopes beyond the limits of the herein described right-of-way where required for the con-
struction and maintenance of said County Highway. RESERVING unto grantor of the above described parcel of land,
his successors or assigns, the right to eliminate such slopes and /or drainage structures or portions thereof, when in the
written opinion of the County and /or District Engineer of Grantee, the necessity therefore is removed by substituting
other protection, support and /or drainage facility, provided such substitution is first approved in writing by said
Engineer(s).
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road building
materials within said right -of -way, including the right to take water, together with the right to use the same in such
manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction, reconstruction,
improvement or maintenance of said highway.
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all damages to Grantor's re-
maining property contiguous to the right -of -way hereby conveyed by reason of the location, construction, landscaping
or maintenance of said highway.
