EASEMENT
S. SCOTT EMSLEY and ROBIN EMSLEY, (Grantor), for valuable consideration,
grants to SAN DIEGO GAS & ELECTRIC COMPANY, a corporation (Grantee), an easement and
right of way in, upon, over, under and across the lands hereinafter described, to
erect, construct, change the size of, improve, reconstruct, relocate, repair, maintain
and use facilities consisting of:
1. Underground facilities and appurtenances for the transmission and
distribution of electricity.
2. Pipelines and appurtenances for any and all purposes.
3. Communication facilities, and appurtenances.
The above facilities will be installed at such locations and elevations upon,
along, over and under the hereinafter described easement as Grantee may now or
hereafter deem convenient or necessary. Grantee also has the right of ingress and
egress, to, from and along this easement in, upon, over and across the hereinafter
described lands. Grantee further has the right, but not the duty to clear and keep
this easement clear from explosives, buildings, structures and materials.
The property in which this easement and right of way is hereby granted is
situated in the County-of San Diego, State of California, described as follows:
Parcel 1 of Parcel Map 5401, filed in the Office of the County
Recorder of San Diego on December 17, 1976 as File No. 76- 423599,
being a division of a Portion of Lots 2 and 5 in Block "C" of South
Coast Park Annex, in the County of San Diego, State of California,
according to Map thereof No. 1788, filed in the Office of the
County Recorder of San Diego County, March 29, 1924.

The easement in the aforesaid lands shall be more particularly
described as follows:
Beginning at a point on the Westerly Line of said Parcel 1,
distant thereon North 15° 43' 46" West, 15.00 feet from the most
Southerly Corner thereof; thence from said POINT OF BEGINNING North
74° 16' 14" East, 132.77 feet to a point of non - tangency with a
20.00 foot radius curve concave Southeasterly, a radial line of
said Curve at said Point bears North 57° 08' 21" West; thence
Northeasterly and Easterly along the arc of said Curve through a
central angle of 60° 46' 59" a distance of 21.22 feet; thence
tangent South 86° 21' 22" East, 35.00 feet; thence South 03° 38'
38" West, 20.00 feet to a point which bears North 86° 21' 22" West,
68.26 feet from Angle Point on the Southerly Boundary of said
Parcel 1; thence along said Southerly Boundary South'860 21' 22"
West, 35.00 feet and South 74° 16' 14" West, 146.00 feet to said
Most Southerly Corner; thence along said Westerly Line North 15°
43' 46" West, 15.00 feet to said Point of Beginning.
ALSO: Excepting therefrom, that portion of said Parcel 1,
shown and delineated as "Existing 5' Easement for Roadway Purposes
granted to the County of San Diego recorded 12- 17 -76, Doc. No.
76- 423379, Book 1976 of O.R." on said Parcel Map No. 5401.
Grantor shall not erect, place or construct, nor permit to be erected, placed
or constructed, any building or other structure, plant any tree, drill or dig any well,
within this easement.
Grantor shall not increase or decrease the ground surface elevations within
this easement after installation of Grantee's facilities, without prior written consent
of Grantee, which consent shall not unreasonably be withheld.
Grantor further grants to Grantee the right to assign any or all of the
rights granted in this easement in whole or in part to Pacific Bell and /or to other
companies providing utility or communication facilities.
Grantee shall have the right but not the duty, to trim or remove trees and
brush along or adjacent to this easement and remove roots from within this easement
whenever Grantee deems it necessary. Said right shall not relieve Grantor of the duty
as owner to trim or remove trees and brush to prevent danger or hazard to property or
persons.
CONDUITS CARRY HIGH VOLTAGE ELECTRICAL CONDUCTORS, AND PIPELINES MAY CARRY
VOLATILE MATERIALS, therefore Grantor shall not make or allow any excavation or fill to
be made within this easement WITHOUT FIRST NOTIFYING SAN DIEGO GAS & ELECTRIC COMPANY
BY CALLING 696 -2000, and OBTAINING PERMISSION.
This easement shall be binding upon and inure to the benefit of successors,
heirs, executors, administrators, permittees, licensees, agents or assigns of Grantor
and Grantee.
