and incidents thereto for a public highway upon, over and across that certain real property in the County of San Diego,
State of California, described as:

Those portions of Lots 20 and 23 of Rancho Las Encinitas according to Map thereof
No. 848 filed June 27, 1898, in the Office of the County Recorder of the County
of San Diego, more particularly described as follows:
Beginning at the most Northeasterly corner of Village Park Unit No. 4 according
to Map thereof No. 7242 filed in the Office of said County Recorder, said point
being on the arc of a 949.00 foot radius curve concave Easterly and in the Easterly
right of way line of Village Park Way as shown on said Map No. 7242; thence
leaving said curve North 80 °08135" West along the prolongation of a radial line
to said curve and along the Northerly boundary of said Village Park Unit No. 4,
a distance of 275.24 feet; thence leaving said boundary North 9 051125" East, 42.00
feet. thence South 80 008135" East, 155.04 feet to the beginning of a tangent
20.00 foot radius curve concave Northwesterly; thence Northeasterly along the
arc of said curve through a central angle of 86 040153" a distance of 30.26 feet
to a point of reverse curvature with a 1051.00 foot radius curve concave Easterly;
thence Northerly along the arc of said curve through a central angle of 9 053158"
a distance of 181.59 feet; thence North 23 004130" East, 295.00 feet to the
beginning of a tangent 1051.00 foot radius curve concave Southeasterly; thence
Northeasterly along the arc of said curve through a central angle of 34 025130"

to the beginning of a tangent 949.00 foot radius curve concave Southeasterly;

j The Grantor hereby further grants to the County of San Diego the privilege and right to extend drainage structures and
excavation and embankment slopes beyond the limits of the herein described right of way where required for the con -
struction and maintenance of said County Highway. RESERVING unto grantor of the above described parcel of land,
his successors or assigns, the right to eliminate such slopes and /or drainage structures or portions thereof, when in the
written opinion of the County and /or District Engineer of Grantee, the necessity therefor is removed by substituting
other protection, support and /or drainage facility, provided such substitution is first approved in writing by said
Engineer(s).
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road
building materials within said right of way, including the right to take water, together with the right to use the same
in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction,
reconstruction, improvement or maintenance of said highway.
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all damages to Grantor's
remaining property contiguous to the right of way hereby conveyed by reason of the location, construction, landscap-
ing or maintenance of said highway.
(As used above, the term "grantor" shall include the plural as well as the singular number and the words "himself' and "his" shall
include the feminine gender as the case may be.)
