RELINQUISHMENT OF HIGHWAY RIGHT OF WAY IN THE
CITY OF ENCINITAS, ROAD 11-SD-5-PM R40 . 69

WHEREAS, by Resolution No. 2010-33 , dated June 16,
2010, the City of Encinitas waived the 90-day notice requirement
and agreed to accept title to highway right of way, upon
relinquishment thereof to said City by the State of California;
and
WHEREAS, the State of California has acquired right of
way for the above-mentioned non-motorized transportation
facilities in the City of Encinitas, adjacent to Route 5 , along
Regal Road north of Santa Fe Drive; and
WHEREAS, this Commission has found and determined, and
does hereby find and determine, that it is desirable and in the
public interest that said non-motorized transportation facilities
be relinquished to the City of Encinitas for use as sidewalks and
pedestrian areas .

NOW, THEREFORE, IT IS VOTED by the California
I
Transportation Commission that it relinquish, and it does hereby
relinquish, to the City of Encinitas, effective upon the
recordation of a certified copy hereof with the Recorder of San
Diego County, all of the State of California' s right, title and
interest in and to said non-motorized transportation facilities
in said City, together with the right of way and appurtenances
thereof, described as follows :
Those portions of non-motorized transportation
facilities of State Route 11-SD-5 contiguous and adjacent
thereto, designated as "Relinquishment No. R31148" , within
SEGMENT 1 and SEGMENT 2 , on that certain relinquishment map,
consisting of two sheets, filed as Document Number 2013-0545669,
on September 3 , 2013, in the State Highway Map Book, as State
Highway Map No. 337 , sheets 1 and 2, in the Office of the County
Recorder of San Diego County.
RESERVING unto the State of California, its successors
or assigns, a ten foot wide easement for utility purposes, over,
under and across said SEGMENT 1, as shown on sheet 2 of said
State Highway Map.

EXCEPTING AND RESERVING to the State of California any
and all rights of ingress to and egress from the highway hereby
relinquished in and to the adjacent and adjoining freeway, except
at such points as now are or may be established by resolution of
this Commission.
THIS IS TO CERTIFY that the foregoing resolution was duly passed by
the California Transportation Commission at its meeting regularly called
and held on the 8"day of October 2013 in the city of Modesto and that the
foregoing is a full and correct copy of the original resolution. Dated this
