assigns,
A permanent and perpetual easement and a temporary construction easement in, upon,
'over and across the lands hereinafter described for the purpose of locating, relo-
cating, replacing, renewing, constructing, reconstructing, altering, changing the
size of, improving, patrolling, operating, cleaning, inspecting and repairing a
sewer pipeline and all appliances, fixtures and appurtenances incidental thereto,
for use in connection therewith, fon•the transmission and distribution of sewage
and all uses and purposes incidental thereto, together with the right of ingress
and egress therefrom, to and along said right of way, by practical route or routes
in, upon, over and across the remaining larger parcel of which said strip of land
is a part, together with the right to clear and keep clear said right of way from
buildings, structures, explosives, trees, and other materials or growths detrimental
.to the uses herein granted.

With respect to Parcels 55 -3 and Parcels 55 -3A It is agreed that the Grantors shall
it have the right, at their own risk, to use the surface of the right of way hereby
granted, for agricultural uses, and without the right to make connections or open-
(+ ings into said subsurface sewer or pipe lines or into said appliances, fixtures or
appurtenances; and the right to cross or make use of the surface in a manner not
detrimental to the installation, construction, operation, inspection, repair, main-
tenance and replacement of a sewer pipe line, or to any other purposes and uses as
are or may be necessary or incidental to the construction, maintenance and operation
of the Grantee's proposed sewer pipe line.
And the Grantor(s) hereby agree for themselves, their successors or assigns, that
they will not construct or cause to be constructed and maintained any buildings or
structures of any nature or kind; or store or permit to be stored or use upon said
right of way any blasting supplies or explosives commonly used for blasting purposes.
The City of Escondido (Grantee) hereby agrees that it will avoid unreasonable inter -
ference with the use by Grantor and his successors of the said right of way, and agrees
not to fence the same, and agrees that the Grantors may enjoy the surface use of the
land herein described, subject to the conditions above stated; and agrees to permit
the installation by the Grantors of sewer pipes reasonably required for Grantors' use
on their said property over and across the right of way in a manner which will not
Interfere with the Grantee's sewer pipe line and operations, provided, if the loca-
tions are to be under Grantee's sewer pipe line, it must be installed subject to
Grantee's supervision and approval. The Grantee agrees, after the installation of
its sewer pipe line, to restore the surface grade above the pipe-to as near the
original elevation as practicable. All improvements affected thereby, such as
fences, corrals, pipe lines, irrigation lines, walls and driveways shall be promptly
replaced at the expense of the grantee. All present installed utilities will be
Interfered with as little as possible and, if interrupted, will be promptly restored
to use at the expense of the Grantee. 55 -IA, 55 -2A,
tIn addition,, and with exclusive respect to Parcels 55 -3A , it is understood and
fi agreed that such said temporary easement shall terminate either upon completion of
construction of the Escondido Sewer Outfall or on September 30 , 1974,
whichever date occurs first. It is also understood and agreed that upon said ter -
{ mination date, the•City of Escondido shall have no further obligation on liability
1 in connection with said temporary easement.

PARCEL 55 -1
An easement and right of way for the purpose of a sewer in, on,
over, under and across a strip of land, 20.00 feet in width, being
a portion of Thirteenth, "M" and "N" Streets of the Colony of Oliven-
hain, in the County of San Diego, State of California, according to
Map thereof No. 326, filed in the office of the County Recorder of
said County, July 8, 1885, and as vacated according to the Super-
visor's Records of said County, Book 361, page 123, March 4, 1915,
TOGETHER WITH a portion of "L" Street, if any, as shown on said
Map No. 326, and being the 7.00 feet adjacent northerly to and
the 13.00 feet adjacent southerly to the following described line:
Beginning at a point in the centerline of said "L" Street,
as said "L" Street is shown on said Map No. 326, distant
7.00 feet southerly measured at right angles to the center-
line of said Thirteenth Street, as said Thirteenth Street
is shown on said Map No. 326; thence South 73 013'36" East
parallel to said centerline of Thirteenth Street 766.88
feet to a point which bears at right angles South 16 046'24"
West 7.00 feet from a point in said centerline of Thirteenth
Street, distant thereon 381.44 feet from its intersection

along the arc of said curve through a central angle of 8 006'45"
a distance of 99.11 feet to a point in said centerline of
Thirteenth Street, distant South 73 013'36" East 99.22 feet
from the intersection of the centerline of said Thirteenth
Street with the centerline of said "N" Street as said "N"
Street is shown on said Map No. 326.
The sidelines of said strip of land shall be fore-
shortened or lengthened so as to terminate Westerly
in the centerline of said "L" Street, and so as to
terminate northeasterly in the centerline of said
Thirteenth Street.
PARCEL 55 -1A
A strip of land 30.00 feet in width, lying adjacent southerly
to said Parcel 55 -1.
The sidelines of said strip of land shall be foreshortened
or lengthened so as to terminate westerly in the center -

width;
Said 10.00 foot -wide portion of said strip of land being a por-
tion of "0" Street of the Colony of Olivenhain, in the County
of San Diego, State of California, according to Map thereof
No. 326 filed in the office of the County Recorder of said
County, July 8, 1885, and as vacated according to the Super-
visor's Records of said County, Book 361, page 123, March 4, 1915,
and described as follows:
The 10.00 foot strip of land bounded on the west by the
centerline of said "0" Street, bounded on the North by
a line parallel to the northerly line of Lot or Tract
25 of Rancho Las Encinitas, according to Map No. 848
filed in the office of the County Recorder of said County,
June 27, 1898, and 20.00 feet southerly thereof, measured
at right angles thereto, bounded on the East by a line
parallel to said centerline of "0" Street, and 10.00
feet easterly thereof, measured at right angles thereto,
and bounded on the South by a line parallel to the follow-
ing described line, and 15.00 feet southerly thereof, mea-
sured at right angles thereto:
Beginning at the Southeast corner of Lot 91 being
the intersection of the centerlines of Thirteenth
and "0" Streets as vacated by the Supervisor's Re-

326, said corner being also an angle point in the

North 15 033'35" East 51.28 feet to the TRUE POINT
OF BEGINNING of the above mentioned line; thence
