From time to time , the Board has continued the hearing on a resolution
of intention to vacate a portion of a street known as Del Mar Shores
Terrace within the boundaries of the proposed subdivision of Del Mar Shores
Terrace (Tentative Map No . 3080 ) , in the Solana Beach area , pursuant to the
request of American General Finance Corporation , Vac . 71 - 34 ; and on
February 13 , 1973 , Minute Item No . 78 , the Board again continued said
hearing to February 28 , 1973 , at 2 : 00 p . m . ; and also continued the con-
current consideration of the final map of Del Mar Shores Terrace , Tentative
Map No . 3080 ; the Planning Commission and the Planning Department having
recommended approval of said vacation concurrent with the approval of the
final map of Del Mar Shores Terrace .
This being the time set and evidence being on file that due and
proper notice o £ said continued hearing has been given as required by law ,
the matter is now called up .
It is noted that an Environmental Impact Report is not required in
this case , inasmuch as the request or petition was submitted prior to the
California Supreme Court decision , the Mammoth Decision .
It is also noted that a letter has been presented to the Board on
February 6 , 1973 , transmitting the proposed Final Map of the Del Mar Shores
Terrace Subdivision ; and recommending that 'the Board approve the proposed
map , accept on behalf of the public Del Mar Shores Terrace for use as a
street , accept the casement for. public pathway and beach access purposes ,
accept an easement for recreational purposes , and accept the easements for
vehicular parking , all as dedicated on said proposed map ; and recommending
that the Board take the necessary action to vacate a portion of Del Mar
Shores Terrace and the portion of Lots 7 and 8 Reserved for Future Street ,
all as shown on Map 5404 , providing the Planning Commission has made the
necessary recommendation therefor , which recommendation has been made .
Kenneth L . Erickson , representing the County Engineer and Road Com-
missioner , orally reviews the background of the case under consideration
and the location of the right of way proposed for vacation , as well as the
private easements in the area over which there was some discussion at prior
hearings ; and states that the subdivision map reflects the conditions of
the special use permit granted to cover the area involved .
E . Ludlow Keeney , Jr . , attorney for the developer , defers his pre -
sentation of arguments until after the attorney for the protestants speaks
. in objection to the proposed vacation .

Arthur Peinado , attorney for the protestants , states that he repre -
sents the owners of Lots 2 , 3 , 4 , 11 , 12 and 13 ; that the owners of these -
lots are concerned about the turnabout or cul - de - sac , and that they want
to protect their 50 - foot easement rights which are located immediately to
the west of the cul - de - sac ; and that his clients are not opposed to the
development per se , but that they are opposed to the vacation of the pro -
posed streets , inasmuch as with the vacation of the cul - de - sac , the
abutting private easement owned by the property owners would be extinguished .
A . P . M . Cochrane , representing the Solana Beach Tom Council , speaks
in opposition to the proposed vacation since the approval of the final map
of Del Mar Shores Terrace goes along with the proposed vacation , indicating
that the existing road which will be left for the travel by the owners of
the existing subdivision units , is pretty narrow , and it will be practically
impossible to turn cars around there because the turnaround has been done
away with ; that he can not see that there will be any remaining easements
for the public across the top of the bluffs , and that drainage is going to
be a very great problem because of the excavation for the underground
garages . He alleges that there has been no soil reports submitted in
connection with the preliminary work on the subdivision ; points out that
the owners of the subdivision units will be a part of the public and also
will have the right to park their cars in those four proposed public park -
ing easements , and submits other arguments ' in opposition to the granting of
the requested road vacation . He urges the Board to continue the hearings
so that all of the pertinent information can be correlated .
After much discussion , Supervisor Craven indicates his desire to make
some positive motions on the subject ; and E . Ludlow Keeney , Jr . , attorney
for the. developer , indicates that he will defer his presentation until after PP
the motions are made , but reserves the right to speak in the event that
these motions fail .
A motion is then made by Supervisor Craven , seconded by Supervisor
Brown , to close the hearing , adopt a resolution vacating and abandoning
the portion of the street known as Del Mar Shores Terrace and to approve
the . final map . for Del Mar Shores Terrace Subdivision .
It is suggested that each of the items be taken separately , and after
further discussion , the Board takes the following actions :

following resolution is adopted :
WHEREAS , on November 14 , 1972 , Minute Item No . 6 , the Board adopted
a resolution of intention to vacate and abandon a portion of a street known
as Del Mar Shores Terrace and portions of Lots 7 and 8 of Del Mar Shores
within the proposed subdivision of Del Mar Shores Terrace (Tentative Map
No . 3080 ) in the Solana Beach area , pursuant to the request of American
General Finance Corporation , Vac . 71 - 34 ; and
WHEREAS , the matter came on for hearing before the Board of Supervisors
on December 9 , 19,72 , at 2 : 00 p . m . , and was continued from time to time to
allow time for the submittal by the developer of the Final Map of Del Mar
Shores Terrace to be considered concurrently therewith ; and was continued
from February 13 , 1973 , to February 28 , 1973 , at 2 : 00 p . m . , at the request
of the developers and
WHEREAS , this being the time set , and evidence is on file that due
and proper notice of said continued hearing has been given as required by
law , the matter is now called up ; and
WHEREAS , the Planning Commission and the Planning Department in a
report filed in the office of the Clerk of the Board of Supervisors on
November 9 , 1972 , Document No . 462865 , recommended approval of the re -
quested road closing concurrently with the approval of the final map of
Del Mar Shores Terrace ; and
WHEREAS , it appears that no written protests or objections to said
proposed vacation have been filed ; and the oral protests or objections of
Arthur Peinado , attorney for six property owners in the area , and A . P . M .
Cochrane , representing the Solana Beach Town Council , have been overruled ;
NOW THEREFORE
The Board of Supervisors hereby finds that due and proper notice of _.
the hearing on the .resolution of intention to vacate said highway has been
given as required by law and that said highway hereinafter described is
unnecessary for present or prospective public use .
IT IS THEREFORE RESOLVED AND ORDERED that the hearing be and it is

with this Board the necessary bonds guaranteeing the improvements of
streets and easements and providing for the setting of monuments ;
ON MOTION of Supervisor Conde , seconded by Supervisor Craven , the
Board hereby approves the final map of said subdivisions accepts on
behalf of the public , those streets , highways and other public ways
and easements and abutters ' rights of access shown on said map and
offered for dedication , if any , as recommended by the Department of
the County Engineer and approves and authorizes the Clerk of the Board
to execute -an Agreement to Improve Subdivision , executed by the American
General Finance Corporation and approved as to form by the County Counsel ;
all as more fully set forth in Board of Supervisors Document No . 466023 .

Minute Item No . 83 , the Board again continued said hearing to February 6 ,
1973 , at 2 : 00 p . m . , Chairman Walsh having expressed a desire to view the
site .
This being the time set , and evidence being on file that due and
proper notice thereof has been given as required by law , the matter is
now called up .
There is presented to the Board a letter from the Department of the
County Engineer submitting for approval , prior to its recordation , the
final map of Del Mar Shores Terrace , said resolution of intention and '
map to ba considered concurrently .
Chairman Walsh states that he has seen the site . It is indicated
that there is not a majority present for positive action either one way
or the other , and the Chairman suggests that said matter be continued .

No . 107 , the Board continued said hearing to January 30 , 1973 , at 2 : 00 p . m . ,
inasmuch the final map of Del Mar Shores Terrace was not ready for concur -
rent consideration .
This being the time set , and evidence being on file that due and
proper notice of said continued hearing has been given as required by law ,
the matter is now called up .
It is noted that the final map of Del Mar Shores Terrace is ready for
concurrent consideration at this time .
Vincent Quasarano , Planning Department representative , orally reviews
the location of • said portion of a street know as Del Mar Shores Terrace and
the location of the proposed Del Mar Shores Terrace subdivision ; describes
the proposed subdivision known as Del Mar Shores Terrace ; and indicates that
when the Board considered the tentative map on said proposed subdivision
there was quite a bit of concern about the beach access , which resulted in
a compromise condition of the location of the access . Mr . Quasarano states
that in essence the recommendation on this would be to approve the requested
road vacation concurrently with the approval of the final map of Del Mar
Shores Terrace .
Arthur G . Peneido , attorney , representing six property owners in the
immediate area , raises several points about which his clients are concerned
such as protection -of the cul - de - sac , a 50 - foot easement over Lots 7 and 8 ,
and whether or not there should be an Environmental Impact Report on a
street vacation . Mr . Peneido is informed of the solution of his problems
about which his clients are concerned , and that an Environmental Impact
Report is not required on the vacation of streets .
E . Ludlow Keeney , Jr . , attorney for American General Finance Corporation ,
informs the Board that last year a very lengthy , difficult series of nego -
tiations between his client and the Environmental Development office went
forward , and that there was no Environmental Impact Statement filed since
this was prior to the Mammouth Decision ; that the entire project has gone
through the environmental gamut , so to speaks and that American General

Finance Corporation has complied with every condition possible in the
filing of its Tentative Map . He urges , therefore , that the Board grant
the requested vacation and approve the final map of Del Mar Shores Terrace .
During discussion , it is brought out that on two occasions the
developer became over - eager and graded the whole site before the Depart -
ment of the County Engineer had finished checking the plans and had
illegally graded an improved County road and an improved cul - de - sac in
the proposed subdivision project before receiving a grading permit .
Kenneth L . Erickson , Department of the County Engineer representative ,
stated that the County had stopped him on these illegal violations .
The Board members express concern about these illegal violations ;
and Chairman Walsh expresses the desire to take a look at the site .
ON MOTION of Supervisor Craven , seconded by Supervisor Conde , the
Board hereby continues said hearing to February 6 , 1973 , at 2 : 00 p . m .

tion of intention to vacate a portion of a street known as Del Mar Shores
Terrace (Vac . 71 - 34 ) , pursuant to the request of the American General
Finance Corporation ; and setting the hearing thereon on December 19 , 1972 ,
at 2 : 00 p . m . The Planning Commission had recommended approval of the
requested road closing concurrent with the approval of the final map of
Del Mar Shores Terrace ( Tentative Map No . 3080 ) .
This being the time set for said hearing , the matter is now called
up . Evidence is on file that due and proper notice of said hearing has
been given as required by law .

position of the Solana Beach Town . Council ' Inc . concerning the grading ?'
of Del Mar Shores Terrace ,
Don Caresio expresses his concern for the building in which he
lives because of the vibrations being caused by the heavy equipment used
to construct the Del Mar Shores Terrace and the erosion such machinery
might cause to the bluff area on which his home is located .
Various questions are raised concerning the environmental impact
and what action the County could take if , having issued the P ermit it
was then found that the construction const coon was having a detrimental environ -
mental effect .
ON MOTION of Supervisor Boney , seconded by Supervisor Craven , the
Board files the report of the County Engineer and requests Supervisor
Craven ' s office and the County Engineer to investigate the allegations
made concerning the grading and the cause of erosion of the bluff area .

On November 14 , 1972 , your Board ( 417 ) delayed action on American General Finance
Corporation ' s petition (VAC 71-34) vacating a portion of Del Mar Shores Terrace ,
Solana Beach , until November 21 , 1972 , pending a report on an allegation made by
Mr . A . P . M . Cochrane that there are grading violations relative to the subject
development , therefore it is my
RECOMMENDATION :
That this report be filed .
Discussion :
The resolution of conditional approval of tentative map No . 3080 for the subject
development was adopted by your Board on March 7 , 1972 , followed by the adoption ,
on May 16 , 1972 , of a resolution amending the resolution of conditional approval .
The conditions set forth in the above resolutions have been incorporated in either
the grading plan for Del liar Shores Terrace or in the final map , as the case may
be . The grading plan (L-6949) was prepared in accordance with the requirements of
the tentative map , and was approved by the Planning Department on November 3 , 1972
in accordance with Section 458 . 5 , County Code of Regulating Ordinances that governs
grading in the coastal zone overlay . The grading permit was subsequently issued
by the County Engineer on November 6 , 1972 . The grading work has started and is
estimated to be 5 - 10% complete . A field investigation indicates that the grading
work conforms to the approved grading plan in so far as that is possible at this
stage of the work .
The tentative map requirements (see attachment ) for this development provide for
the dedication to the County of a fully-improved 29 stall parking lot , a continuous
12 foot wide walkway and a stairway leading from the top of the bluff to the beach .
These improvements are to be provided by the developer , at his cost , as a condition

of the vacation (71-34) of approximately 100 feet of the westerly end of the street
called Del Mar Shores Terrace , and the vacation of an unimproved 50 foot .future
street easement from the end of Del Mar Shores Terrace to the mean high tide line .
These dedicated improvements will be of substantial benefit to the public . The
public cannot effectively use the easement for beach access at the present time .
The bluffs are too steep and would require the construction of stairs prior to
using for beach access . Additionally , the on-street parking capacity could not be
expected to accommodate the demand , even if the present easement was improved with
a stairway .
The developer , in this case , has provided a substantial improvement toward provid-
ing suitable and readily available beach access facilities for the public . In our
opinion , these public benefits far exceed the benefits currently available from
the vacated street and future street easement .

As requested , when we met on Tuesday last , the purpose of this
letter is to confirm that grading has been done adjacent the top
of bluffs and around DELMAR SHORES TERRACE in Solana Beach .
It is our understanding that no grading permit was obtained
to cover this work and we believe far more than 200 cu . yards are
involved . This amount , we are told , does not require a grading
permit ! In such a ' sensitive ' area where the C . D . Overlay Zone
ordinance is involved , it may appear there has been a gross viola-
tion .
If we may repeat ' hearsay ' information , which we cannot con-
firm , this violation is of comparatively long standing and dates
from the construction of ' Seascape V . It is said the proceeds
from this grading were delivered to Westward Construction for pads
on that site !
In view of the erosion difficulties now threatening the adja-
cent structures at top of bluffs , on the De1Mar Beach Club property ,
this disturbance of the surface - in this area - may have grave con-
sequences .
It might seem a Court action by the County authorities is indi-
cated .

WHEREAS , after investigation the County Planning Commission
has approved and recommended the proposed vacation ( Document No .
462865 ) ; and
WHEREAS , it appears to this Board that said hereinafter
described highway is not needed for present or prospective use as
a county highway ; NOW THEREFORE
BE IT RESOLVED by the Board of Supervisors of the County of

This is in reference to the attached request of American General
Finance Corporation for the vacation of a portion of Del Mar
Shores Terrace as shown on the attached vicinity map .
At its regular meeting of January 21 , 1972 , after considering
this matter, the
PLANNING COMMISSION RECOMMENDED :
Approval of the requested road closing concurrent with the
approval of the final map of Del Mar Shores Terrace (T . M. 3080 ) .
PLANNING DEPARTMENT RECOMMENDATION :
(Same as Commission recommendation . )
Discussion :
Del Mar Shores Terrace , which extends approximately 450 feet westerly
from Sierra Avenue , was dedicated on the subdivision map of Del Mar
Shores , Map 5404 . The applicant , in connection with a proposed
condominium project , has requested that the westerly 120 feet of
said road as well as those portions of the Lots 7 and 8 , reserved for
future street , be vacated .
