real property in the County of San Diego, State of California, described as follows: O, {

That portion of Lot 1 in Block 1 of Vermillion Tract, in the County of San Diego, C
State of California, according to Map thereof No. 2195 filed in the Office
of the County Recorder of said County, conveyed to Harold J. Anderson, et ux,
in deed recorded July 3, 1974, as File/Page No. 74-178780 of Official Records
in the Office of said County Recorder, lying Westerly of a line that is parallel
with and 42.00 feet Easterly of the Official Centerline of SC 1470 (Vulcan
Avenue) on file with the County Engineer of said County and lying Easterly
of that easement to the County of San Diego, recorded April 28, 1975 as
File/Page No. 75-099427 in the Recorder's Office of said County.
TOGETHER with that portion of land conveyed to Anderson lying within a a!
70.00 foot radius circle whose center is at a point that is 20.00 feet
Southeasterly of the centerline of Cereus Street and 20.00 feet Northeasterly
of the centerline of Hermes Avenue, according to Parcel Map No. 3125 on file'
in said Recorder's office. ; M

The Grantor hereby further grants to the County vi ban Diego the privilege and right to extend ;
drainage structures and excavation and embankment slopes beyond the limits of the herein
described right-of-way where required for the construction and maintenance of said Countyi `
Highway. RESERVING unto grantor of the above described parcel of land, his successors or
assigns, the right to eliminate such slopes and/or drainage structures or portions thereof, when 0 !
in the written opinion of the County and/or District Engineer of Grantee,the necessity there- ?
fore is removed by substituting other protection, support and/or drainage facility, provided
such substitution is first approved in writing by said Engineer(s).
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter
grow),and road building materials within said right-of-way, including the right to take water, y f
together with the right to use the same in such manner and at such locations as said Grantee may
deem proper, needful or necessary, in the construction, reconstruction, improvement or maintenance
of said highway.
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all
damages to Grantor's remaining property contiguous to the right-of-way hereby conveyed by reason Z
of the location, construction, la dscaping or maintenance of said highway.
