The Southerly and Easterly 10.00 feet of that portion of Lots 10 and 11
in Block 3 of Avocado Acres In the County of San Diego, State of California,
according to Map thereof No. 1791, described in deed to Elvin R. McCunn, '
et ux, recorded in the Office of the County Recorder of said San Diego
County, August 8, 1973 as File/Page No. 73-220660.
TOGETHER with that portion of said McCunn land lying Southeasterly of the
arc of a 20.00 foot radius curve concave Northwesterly, said curve being �■

" The Grantor hereby further grants to the County''of-San Diego the privilege and right to extend drainage structures and
nK excavation and embankment slopes beyond the limits of the herein described right of way where required for the con- . d s
struction and maintenance of said County Highway. RESERVING unto grantor of the above described parcel of land,
his successors or assigns,the right to eliminate such slopes and/or drainage structures or portions thereof, when in the
written opinion oft the County and/or District Engineer of Grantee, the necessity therefor is removed by substituting
other protection, support and/or drainage facility, provided such substitution is first approved in writing by said
Engineer(s).
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter`grow), and road
1 building materials within said right of way, including the right to take water, together with the right to use the same
in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction, O {
reconstruction, improvement or maintenance of said highway.
The Grantor, for himself, his successors and assigns,hereby waives any claim for any and all damages to'Grantor's i
f remaining property contiguous to the right of way hereby conveyed by reason of the location, construction, landscap
} ing or maintenance of said highway.
