'} That certain mining claim or premises, known as the Encinitas Copper Mine No. 10,
lode mining claims, designated by the Surveyor General as Lot No. 4013, embracing
a portion of Sections 5 and 4 in Township 13 South, Range 3 West, San Bernardino
Meridian, in the County of San Diego, State of California, more particularly
' described in the United States Patent for said premises dated January 31, 1905
i and recorded in Book 7, Page 331 of Patents, in the Office of the County Recorder
of said San Diego County.

f Bud easement of right of way in the aforesaid lands is particularly described as follows:
Parcel A
All those portions-of the lands first above described lying within a strip of land
l 30.00 feet of even width, the Southwesterly line of said 30.00 foot wide strip of
,i land, being parallel with and distant 20.00 feet Southwesterly, measured at right
angles from the Southwesterly line of that certain 100.00 foot wide strip of land G
as described in Deed to the San Diego Gas and Electric Company filed in the Office
of the County Recorder of said San Diego County March 3, 1954, as Document No.
27238 in Book 5158, Page 122 of Official Records.
l Parcel B
The Westerly 20.00 feet of said Lots 3 and 4 in said Section 5.
TOGETHER WITH the right and privilege to spill water into the existing natural
drainage swale on the lands of the grantor herein, which said swale drains in r>;
an Easterly direction and crosses the Westerly boundary of said Lot 4 in Section
4 5 at a point approximately 539 feet Northerly from the Southwest corner of said
Lot 4.
ALSO TOGETHER WITH an easement for temporary working strips of land, situated
within the lands first above described, said easement shall include, but not be
s limited to, the right and privilege of workmen, contractors, and any and all
j agents employed by the Grantee herein, to use and occupy said temporary working +
strips for the purpose of constructing the hereinbefore mentioned pipeline or
pipelines, and any and all appurtenances incidental thereto, and said easement shall f '
include the right and privilege to place and operate any and all machinery on said
strips which the Grantee herein, or any agent or contractor employed by said
Grantee, deems necessary for the construction of said pipeline or pipelines. i

Said temporary working strips hereinabove referred to being more particularly
described as follows:
Parcel C
' A strip of land 40.00 feet of even width, the Northeasterly line of said 40.00
foot wide strip of land being the Southwesterly line of the 30.00 foot wide strip
of land described in Parcel A above.
Parcel D
The Easterly 40.00 feet of the Westerly 60.00 feet of said Lots 3 and 4 in said
Section 5.
} It is hereby understood and agreed upon by the Grantor and Grantee herein, that
the right and privilege set forth for the use of the above described temporary
2 working strips shall be in full force and effect from the date of execution of

this instrument, and shall continue in full during the construction of said pipe- ,,•
line, and that upon completion, final inspection, and acceptance of the pipeline
by said Grantee herein, the easement for the temporary working strips hereby ,
granted and described above, shall cease and terminate, and become of no further

It is also understood and agreed upon by the Grantor and Grantee herein, that
the grant and termination of the easement for the temporary working strips here-
j inabove described shall in no way affect or frustrate the continued enjoyment and
use of the 30.00, foot and 20.00 foot wide easements described in Parcels A and ! `

Grantee shall have the right to erect,maintain and use gates in all fences which now cross or shall hereafter cross said route or

l venient and safe exercise of the rights hereby granted,the right to transfer and assign this easement in whole or in part being here-

Grantor agrees that no other easement or easements shall be granted on,under or over said snip of land by Grantor,without
the previous written consent of Grantee.
