On motion of Member Shaw seconded by Member Hall f
the following Resolution is adopted:
WHEREAS, on the 10th day of June , 196 9 , this Board duly
passed and adopted a Resolution of Intention to dedicate to the County of San Diego an
' Easement of Right of Way over and across real property belonging to the ENCINITAS UNION
SCHOOL DISTRICT of San Diego County, and hereinafter described, for the purpose of
future widening of Capri Road,portions of Burgundy Road and Rainbow Ridge Lane and
installing certain improvements in said Right of Way in the vicinity of ENCINITAS stating
in said Resolution that a public hearing upon the question of making such dedication I '
would be held by this Board on the 8th day of July , 1969 at 185
Union Street, Encinitas, San Diego County, California, at P. m; and _
{, WHEREAS, notice of the adoption of said Resolution of Intention to dedicate was
duly given by posting copies of said Resolution, signed by the Members of said Board,
at the following places in said District:
Central School, 185 Union Street
Pacific View School, 608 Third Street
ocean Knoll School, 910 Melba Road
and copies of the Resolution were posted for not less than ten (10) days before the
date of this meeting; and also said Resolution was published once not less than five (5)
days before this meeting in the Encinitas Coast Dispatch
a newspaper of general circulation published in the County of San Diego and having a

general circulation in said District; and
! WHEREAS, this is the time and place set forth in said Resolution of Intention for
a hearing on the question of said proposed dedication, and no person now appearing to
object or protest either verbally or in writing against the same; and
WHEREAS, four board members
of this Board are present and have agreed that it is desirable and expedient that said
dedication be made, NOW, THEREFORE,
BE IT RESOLVED by the Governing Board of the ENCINITAS UNION SCHOOL DISTRICT of
San Diego County, California, that an Easement of Right of Way for public street and
highway purposes be dedicated to the County of San Diego for the purpose of future widen-
'' ing of Capri Road, Burgundy Road and Rainbow Ridge Lane and installing certain improve-
ments in said right of way in the vicinity of Encinitas, over and across real property
belonging to the ENCINITAS UNION SCHOOL DISTRICT, and more particularly described as follows:
Those portions of the portions of the SW4 of the NW-4 of Section 3, T.13 S., R. 4 W.,
S.B.B.&M. described in deeds to ENCINITAS UNION SCHOOL DISTRICT of San Diego
'. County recorded as Document No. 46626 on March 20, 1962 and as Document
No. 47523 on March 21, 1962 in the Office of the Recorder of said County of
San Diego described as follows

The northerly 10 feet of that portion of the District's land so described in
deed recorded March 20, 1962 as Document No. 46626.
Parcel 69089-B

That portion of said District's land lying southerly of the southerly line of

lying northeasterly of a 20 foot radius curve concave southwesterly, that is
tangent both to said southerly line of Parcel 69089-A and to said westerly line

BE IT FURTHER RESOLVED that the President of this Board be and is hereby author-
ized and directed to execute and deliver in the name of said District, a Deed of
Dedication of the above described real property to said County of San Diego for said
purposes.
