SUPERCEDED BY RELOCATION $

ON MOTION of Supervisor Hedgecock, seconded by Supervisor Hamilton

following resolution is adopted: {

WHEREAS, Ms Margot Schluter has requested the vacation of the hereinafter
described portion of a County Highway (Document No. 618534); and
i
WHEREAS, Section 960.1 of the Streets and Highways Code, provides that the
Board of Supervisors of any County may retain or may summarily vacate any j
portion of a County Highway which portion has been superceded by relocation; k# £

WHEREAS, the County Planning Commission has recommended said portion of a
County Highway be vacated (Document No. 618534); and
WHEREAS, this Board adopted a Resolution on July 18, 1979 (No. 7) vacating
a portion of County Highway superceded by relocation; and x
WHEREAS, said Resolution did not properly reflect the intent of this Board s
because of an apparent error in the property description of said Resolution; `z
and
WHEREAS, said Resolution as adopted did not effectively vacate the portion
of a County Highway superceded by relocation because of the apparent error in
the property description; and r s
WHEREAS, this Resolution is submitted to this Board for adoption which rl
will properly reflect the intent of this Board and effectively vacate the
portion of a County Highway as superceded by relocation; NOW THEREFORE {
BE IT RESOLVED that this Board of Supervisors finds that the Resolution ),
adopted on July 18, 1979 (No. 7) vacating a portion of a County Highway super-
ceded by relocation did not properly reflect the intent of this Board because of {
an apparent error in the property description of said Resolution.
BE IT FURTHER RESOLVED that said Resolution adopted on July 18, 1979 `
(No. 7) be and is hereby rescinded; and
WHEREAS, it appears to this Board that said portion of County Highway as F
recommended for vacation by said Commission is not needed for present or pros- f
pective use as a County Highway; NOW THEREFORE

IT IS FOUND, DETERMINED AND DECLARED that the portion of a County Highway to be
vacated cannot be used as a non-motorized transportation facility, and that the
proposal is not subject to the. environmental impact review process; ACCORDINGLY
BE IT RESOLVED that this Board of Supervisors finds that the hereinafter
described portion of a County Highway has been superceded by relocation and that r,
the vacation thereof will not cut off all access to the property of any person ?
which, prior to such relocation, adjoined said portion of County Highway; and
BE IT FURTHER RESOLVED that this Board of Supoervisors finds that there is
no present or prospective public use for the hereinafter described portion of R
a County Highway and said portion of County Highway is hereby vacated pursuant iz
to the procedures prescribed by Chapter 3 (commencing with'Sectior. 8320), Part 3,
Division 9 of the Streets and.Highways Code: '

All that portion of Coo Street, together with that ortion of Lot 5
"Reserved for Future Street " in the County• of San Diego, State of.
California, as shown on the Subdivision of Exclusive Acres, Map No. 3257,
filed in the Office of the Recorder of said County, lying Easterly of a ,
line that is 25.00 feet Easterly of and parallel with a line described as
follows: i' 4
BEGINNING at a point designated "Mon on P.I." for the centerline of Coop s
Street as shown on Subdivision of La Costa Del Pacifico, Map No.. 8359, filed
in said Office of the Recorder of said County; thence South 06°16'11" East
to the beginning of a tangent 250 foot radius curve concave Easterly, said
curve being also tangent to a line that is 25 feet Easterly of and parallel `
with the Westerly line of Coop Street as shown on said Map No. 3257, said �{
Westerly line bears South 15 043'30" East, thence Southerly along the arc of.
said curve through a central angle of 09 027'19", a distance of 41.26 feet to
said parallel line; thence South 15°43'30" East, along said parallel line to
the Westerly prolongation of the Southerly line of Lot 6 of said Map No. 3257. # 5
