and Rattan ' s Subdivision) . . . . . . . . . . . . )
WHEREAS, on April 12, 1948, there was presented to the Board of Supervisors a
petition signed by Alex D. Reseck , and nine other freeholders , praying for the vaca-
tion and abandonment of a portion of the width of G Street , Encinitas , in the County
of San Diego , State of California, more particularly described by the County Surveyor
as follows :
The northerly 10 feet and the southerly 10 feet of that certain
unnamed street (!mown as "G" Street ) in Sturges and Rattan ' s Sub-
division, according to the map thereof No . 33 , filed in the office
of the Recorder of San Diego County, lying southerly of East Block
7 and northerly of East Block 8 from the easterly line of Victor
Street to the easterly line of said subdivision ;
and the Board submitted said matter to the County Planning Commission for report and
thereafter set the matter for hearing ; and
WHEREAS, the matter came on for hearing before the Board of Supervisors on May 17,
1948, having been regularly continued until that date , at which time there were on file
affidavits of publication and posting showing that due and proper notice of said hear-
ing had been given as required by law; and
WHEREAS , the County Planning Commission in its report dated May 17 , 1948, recom-
mended that the petition be denied for the reason that there is a row of Eucalyptus
trees on each side of the roadway which would then be on private property; and
WHEREAS , in accordance with the request of petitioners the Board continued the
hearing for eight weeks in order that the matter might be resubmitted to the Planning
Commission; and
WHEREAS, the County Planning Commission in its second report dated June 3 , 1948
(Document No . 89411) recommended that seven and one-half feet on each side of G Street
be vacated in order that said trees might remain on the County right of way, which
vacation would also clear the garage which at present encroaches on the County' s right
of way; and
WHEREAS , it appears that no written protests or objections to the proposed vaca-
tion and abandonment of said portion of G Street have been filed, and no oral protests
or objections to such vacation have been made ;

NOW THEREFORE, the Board of Supervisors finds that due and proper notice of the
hearing has been given as required by law, and that said portion of the width of G
Street is unnecessary for present or prospective public uses accordingly,
IT IS RESOLVED AND ORDERED, on motion of Supervisor Howell, seconded by Supervisor
Bird, that that certain portion of G Street in Encinitas, in the County of San Diego,
State of California, described as follows , be and the same is hereby vacated and abandon-
ed in accordance with the recommendation of the County Planning Commission:
The northerly 7.5 feet and the southerly 7 . 5 feet of that certain
unnamed street (known as n(1n Street ) in Sturges and Rattan ' s Sub-
division, according to the map thereof No . 33 , filed in the office
of the Recorder of San Diego County, lying southerly of East Block
7 and northerly of East . Blook 8 from the easterly line of Victor
Street to the easterly line of said subdivision .
PASSED AND ADOPTED by the Board of Supervisors of the County of San Diego , State
of California, this 12th day of July, 1948, by the following vote :

This has reference to your letter of 1.iay 24 , 1948 , regarding
the petition of Alex D . Reseck for the vacation of a portion
of G Street in 5ncinitas , Petitioner requesting a reduction
of 10 ft * each side of G Street , reducing the width of the
street to 60 ft .
Upon investigation it was found that if 10 ft . were vacated
on each side of G Street , the County would lose a row of trees
on each side of the right-of- way . It was also found that the
reason for this request is that a garage has been built out in
the right _of_way . If 74 ft . were vacated , it would clear the
garage and lazep the row of tree s within the right -of- way .
At its regular meeting of biay 28 , 1948 , the Planning Commission
recommended the vacation of 7'T ft , on each side of G Street .

Dear Mr . Reseck :
On May 170 1948s at the hearing on your petition for vaction of a portion
of "G" Street in Encinitas , the Planning Cozunission ' s report was presented
to the Board reading in part , as followst
Upon field investigation it was found that there is a row of Eucalyptus
trees on each side of the roadway, and if this right-of-way were va-
cated from 80 feet to 60 feet , the trees would then probably be on
private property and the County would not have any jurisdiction over
their removal . An investigation was made by the County Tree Surgeon
as to whether these trees are worth saving, and his report to the Com-
mission was that the trees should be saved ; therefore , the Planning
Commission , at its regular meeting of May 14 , 1948, recommended that
the request be denied .
Supervisor Howell informed the Board that he had received a telephone mes
sage from Mr . Moxness of LnciiAtas asking that the hearing on this petition
be continued for 30 to 60 days , until the matter could be resubmitted to the
Planning Commission. It was suggested that the portion to be vacated might
be reduced to eliminate the portion of right of way on which the row of
eucalyptus trees are located .
The Board therefore continued the hearing for eight weeks , or until Monday,
July 12, 1948 at 11. 900 a . m.

TO THE BOARD OF SUPb:HVISORS CF SAN DIEGO COUNTY, CALIFORNIA :
We . the undersigned , including abutting owners and other
property owners of San Diego County , hereby petition and request
You to vacate ten feet in width on each side of #G" Street , between
Victor Street and Carnish Drive , in Encinitas , California , for the
reason that said street and the traffic thereon serve , and are for
the service only , of the immediately contiguous area and not at all
used as a thoroughfare between points elsewhere ; that eighty feet
in width is more than is required for such convenient and complete
use , and the maintenance of the eighty foot street , when a sixty foot
street would amply serve , is burdensome to San Diego County , as well
as an unnecessary abridgement of property rights of the abutting
owners .
