ON MOTION of Supervisor Taylor , seconded by Supervisor Bear ,
the following resolution is adopted :
WHEREAS , on July ) 1974 , the Board adopted a resolution declaring
its intention to vacate and abandon a six - foot public walkway along
Lots 381 and 409 , Village Park Unit 9 , Map 9549 in the Encinitas
area ; and
WHEREAS , the matter came on for hearing before the Board of
Supervisors of the County of San Diego , State of California , this
21st day of August , 1974 , at 9 : 30 a . m . , and evidence being . on file
that due and proper notice of said hearing has been given as required
w%T law ; and
WI-IEREAS , the Planning Commission , in its report filed in the
office of the Clerk of the Board of Supervisors on June 27 , 1974
( fioard of Supervisors Document No . 490256 ) recommended that said
public walkway be vacated as requested by Barbour Engineering Company ;
and
WHEREAS , it appears that no written protests or objections to
said proposed vacation have been filed , and no oral protests or
o 1` ecti.ons 'L ►ave been made ; NOW THEREFORE ,
The Board of Supervisors hereby finds that due and proper
notice of the hearin g on the proposal to vacate said public walkway
has bee n given as r6 uired by law , and that said walkway hereinafter
described is unnecessary for present- or prospective public use .

IT IS RESOLVED AND ORDERED that the hearing be and it is hereby
closed ; that a finding that said vacation is not subject to the
environmental impact evaluation process be and it is hereby made ;
and that the following described public walkway be and it is hereby
vacated and abandoned :
Parcel 74 - 0690 A
All that 6 foot portion as shown and dedicated as a " Public
Walk" on the Map of Village Park Unit No . 9 , Map No . 7549 , as
filed in the Office of the County Recorder of the County of
San Diego , State of California , lying adjacent to the Northerly
line of Lots 381 and 409 of said Map .
