ON MOTION of Supervisor Brown, seconded by Supervisor Conde,
the following resolution is adopted: 0
WHEREAS, on December 10, 1975, the Board adopted a resolution !CL
declaring its intention to vacate and abandon a portion of Orpheus Avenue 'H
approximately 1000 feet north of Leucadia Boulevard in the Leucadia
area; and

WHEREAS, the matter came on for hearing before the Board of d
Supervisors of the County of San Diego, State of California, this
21st day of January, 1976, at 10:00 a.m. ; and evidence being on file
that due and proper notice of said hearing has been given as required
by law; and �.
WHEREAS, the Planning Commission, in its report filed in the
office of the Clerk of the Board of Supervisors on December 1, 1975
(Board of Supervisors Document No. 514284) recommended, with the O
concurrence of the Department of Land Use and Environmental Regulation,
that said portion of highway be vacated as requested by Perry Arden;
and I
WHEREAS, it appears that no written protests or objections to
the proposed vacation have been filed; and no oral protests or
objections have been made; NOW THEREFORE,
The Board of Supervisors hereby finds that due and proper notice
of the hearing on the proposal to vacate said portion of highway has
been given as required by law, and that said portion of highway herein- D)
after described is unnecessary for present or prospective public use.
IT IS RESOLVED AND ORDERED that the hearing be and it is hereby
closed; that a finding be and is hereby made that the requested vacation
is not subject to the environmental review process, pursuant to
Section 6.2(b) of the San Diego County Procedures for Environmental
Impact Review; and that the following described portion of County l� "
