RESOLUTION VACATING EXCESS RIGHT-OF-WAY
OF A COUNTY STREET HIGHWAY OR PUBLIC NO FEE D
SERVICE EASEMENT VAC80-08 Cn
ON MOTION of Supervisor Hamilton seconded by Supervisor Hedgecock
the following resolution is adopted:
WHEREAS, Buck, McCarty and Associates has requested the vacation of the Z
hereinafter described portion of a County highway (Document No.638689 );and
WHEREAS, Section 8334 of the Streets and Highways Code, provides that the
Board of Supervisors of any County may retain or may summarily vacate any m
portion of a County Highway which portion is excess right-of-way and not
required for said highway; and O
WHEREAS, the County Planning Commission has recommended said portion of 0
County highway be vacated (Document No. 638689 ); and 0
WHEREAS, it appears to this Board that said portion of County highway as C
recommended for vacation by said Commission is not needed for present or Z
prospective use as a County highway; NOW THEREFORE Z
IT IS FOUND DETERMINED, AND DECLARED that this Board of Supervisors finds
pursuant to the attached Negative Declaration dated March 20, 1980, that the
requested vacation will not have a significant effect on the environment, and C
certify that the attached Negative Declaration is complete and in compliance
with the provisions of the California Environmental Quality Act; ACCORDINGLY, m
BE IT RESOLVED AND ORDERED that the vacation of the hereinafter described M
County highway is consistent with the General Plan of the County of San Diego;
and r
BE IT FURTHER RESOLVED that this Board of Supervisors finds that the ■
hereinafter described portion of County highway is excess right-of-way and not r
required for said highway; and cannot be utilized as a non-motorized
transportation facility; and r
BE IT FURTHER RESOLVED that the hereinafter described portion of County
highway be and is hereby vacated pursuant to the procedures prescribed by M
Chapter 4 (commencing with Section 8330), Part 3, Division 9 of the Streets and
Highways Code: M
