The Grantor hereby further grants to the County of San Diego the privilege and right to extend drainage structures and
excavation and embankment slopes beyond the limits of the herein described right of way where required for the con-
struction kind maintenance of said County Highway. RESERVING unto grantor of the above described parcel of land,
his successors or assigns,the right to eliminate such slopes and/or drainage structures or portions thereof, when in the
written opinion of the County and/or District Engineer of Grantee, the necessity therefor is removed by substituting
other protection, support and/or drainage facility, provided such substitution is first approved in writing by said

Engineer(s).
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road
building materials within said right of way, including the right to take water,together with the right to use the same
in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction,
reconstruction, improvement or maintenance of said highway.
The Grantor,for himself, his successors and,assigns,hereby waives any claim for any and all damages to Grantor's
remaining property contiguous to the right of way hereby conveyed by reason of the location, construction, landscap-
ing or maintenance of said highway.
(As used above, the term"grantor"shall include the plural as well as ilia singular number and the words"himself'and."his"shall.
include.the feminine gender as the case may be.)

WHEREAS, on August 20, 1971, the San Diego County Board of Supervisors adopted
� Ordinance No. 3740 (New Series);

WHEREAS, said Ordinance provides that no building permit for construction or alter-
ation of specified types of buildings will be issued from and after January 1, 1972,

within any mumtiple-residential zone, commercial zone, or manufacturing zone on a parcel
t of land which adjoins a County road with established official centerline in the Circulation
{ Element of the San Diego County General Plan unless the standards of adequacy for the right

� - of way and improvements of that road, as those standards are established in said Ordinance,

WHEREAS, GARY BEECHER, an unmarried man, and SETH HOENIG, an unmarried man, are the
owners of the following described property:

NOW THEREFORE
The owners hereby declare that all the property described above is held and shall be
held, conveyed, hypothecated or encumbered, leased, rented, used, occupied and improved
subject to the following covenants, which shall run with the land and shall be binding
on all parties having or acquiring any right, title, or interest in the described lands
or any part thereof.
j No protest shall be made by the owner to any proceedings for the installation or 7
tacquisition of street improvements under any special assessment proceedings, whether
conducted pursuant to the Improvement Act of 1911 or the Municipal Improvement Act of
1 1913, or any other applicable state or local law, and whether processed by the County of
San Diego or any other governmental entity having jurisdiction in the matter and for the
purposes of determining property owner support for such same.
