RESOLUTION VACATING AND ABANDONING H
A PORTION OF COUNTY HIGHWAY '■ '
SUPERSEDED BY RELOCATION
On motion of Supervisor Bates, seconded by Supervisor Conde the
following resolution is adopted:

WHEREAS, James Horr and Dorren McConnell have requested the vacation of
the hereinafter described portion of a County highway (Document No.504537 );
and
WHEREAS, the County Planning Commission has recommended said portion of
County highway be vacated (Document No. 504537 ); and

WHEREAS, it appears to this Board that said portion of County highway as
recommended for vacation by said Commission is not needed for present or

prospective use as a County highway and that said portion has been superseded
by relocation; NOW THEREFORE
IT IS FOUND, DETERMINED, AND DECLARED that the proposal is not subject

to the environmental impact review process; ACCORDINGLY,

BE IT RESOLVED that this Board of Supervisors finds that the hereinafter o
described portion of County highway has been superseded by relocation and that
the vacation thereof will not cut off all access to the property of any person
which, prior to such relocation, adjoined said portion of County highway.

That portion of East Fulvia Street, lying Westerly of a line, parallel with and Q.
5 feet Westerly of the Southerly prolongation of the Westerly line of Hygeia !
Avenue, 50 feet wide, as shown on the Map of South Coast Park, Map No. 1776,
filed in the Office of the County Recorder of San Diego County, State of
California, November 1923. Also lying Northerly of a line parallel with and y
51 feet Northerly from the centerline of R.S. 1799-2 as shown on map thereof,
filed in the Office of the County Engineer of said County, November 11, 1971.
EXCEPTING therefrom that portion lying Southeasterly of a 20 foot radius curve
concave Northwesterly and tangent to said line 5 feet Westerly and parallel to
the Southerly extension of the Westerly line of Hygeia Avenue and tangent to said
parallel line 51 feet Northerly from the centerline of R.S. 1799-2.
RESERVING therefrom an easement for excavation and/or embankment. Said easement ,
being a strip of land 4.00 feet wide lying Southerly of and contiguous to a line 4
55 feet Northerly of and parallel to the centerline of said R.S. 1799-2.
RESERVING AND EXCEPTING from vacation and abandonment easements and rights
pursuant to any existing franchise or renewals thereof, or otherwise, at any o
time, or from time to time, to construct, maintain, operate, replace, remove, ! 0
renew and enlarge lines of pipe, conduits, cables, wires, poles, lines,
telegraphic and telephone lines and for the transportation or distribution
of electrical energy and water and for incidental purposes including access !*
to protect the property from all hazards in, upon; over and across the above Imo.
described portions of highways proposed to be vacated and abandoned; and
RESERVING AND EXCEPTING from vacation and abandonment easements and rights
at any time and from time to time to construct, maintain, operate, replace,
remove and renew water lines, sanitary sewers, storm drains and appurtenant
structures including access to protect the property from all hazards in, upon,
over and across the above described portions of highways proposed to be vacated
and abandoned.
