1_ Patricia K_ Applegate, as to a 50% ownership interest, and Brion B_ Applegate, as to a 50%
ownership interest, as tenants in common, entered into an "Agreement to Improve Development
Water Facilities" as owner per Document No. 2008-0592076 recorded November 14, 2008_ The
Agreement detailed the requirement for the construction o£public water improvements within the
property located in Rancho Santa Fe, California (APN 266-053-26)_
2_ DJEM LL-C--became successor in interest to the properly as owner_
3_ Said Agreement, including the plans and specifications for said improvements, is on file
with the Office oFthe Clerk of the Board of Directors_
4. Said improvements were completed by the owner and accepted by the San Dieguit- Water
District Board -£Directors on the 25`h day-£April, 2012_
S. DJEM LLC posted security in the amount of $41,635_ Seven-Sve percent (75%) o£the
security has been released_ The District will retain twenty-five percent (25%) of the security in the
amount of$10,41 5_ This Security will be released at the end of the one-year warranty period_
6_ Ali requirements of said Agreement have hereby been satisfied except for warranty_
7. Neither acceptance of said improvements by the Board of Directors nor this Notice
constitute a waiver of any defects in the work o£ the construction or installation of said
improvements_
