1. Scripps Health as SUBDIVIDER entered into a lien covenant for the benefit of the San Dieguito
Water District_ The "Lien Covenant Regarding Real Properly= Improvements Required as Condition on
Final Approval of Subdivision o£Real Property", was recorded witb the County Recorder o£the County of-
San Diego as Document No_ 2010 0067277 on February 9, 2010_ The Covenant detailed the
requirements for the construction and installation o£public water mains and appurtenances, within the
property known as Scripps Hospital 354 Santa Fe Drive, Encinitas.
2_ Said Covenant, including the plans and specifications for said improvements, is on £le in the
Of£ce oFthe Clerk ofthe Board of Directors.
3. Said improvements were completed by the SUBDIVIDER and accepted by the San Dieguito Water
District Board of Directors on the 25th day of May, 201 1_
4. Bond No_ 105381016 from Travelers Casualty and Security Company of America in the amount o£
$110,900-00 may be released at this time_ The District will retain the Bond Certificate in the amount of
$36,980.00, which shall be released at the end oFthe one-year warranty period minus expenditures on this
account for warranty_
5. All requirements of said Agreement have hereby been satisfied except for warranty and may be
released_
6_ Neither acceptance of said improvements by the Board of Directors nor this Notice constitute a
waiver of any defects in the work of the construction or installation of said improvements.
